§ 22-1. Service charge.

The city furnishes to the residential, commercial, business, and manufacturing community thereof, services and facilities in connection with its sanitation and sewerage system. In consideration of such services and facilities, city council shall set charges by resolution.

§ 22-2. Collection responsibilities.

It shall be the duty of the finance director to collect all charges herein provided for.

§ 22-3. Manner of billing and collection.

(a) With respect to all those users of the city's sanitation and sewerage system who receive water service from Golden State Water Company, the charges established herein shall be due and payable at the same time and in the same manner as the fees charged for water service by said company.

(b) With respect to those users of the city's sanitation and sewerage system who do not receive water service from the Golden State Water Company, the finance director shall prepare and render a bill for the amount due, at least once every three months, or on such more frequent basis that he shall determine appropriate in line of the fiscal requirements of the city. Said amount shall become due and payable upon rendering of the bill. The handing of the bill to such user in person, or the placing of the bill in an envelope or upon a postal card addressed to the user at the street address of his residence or business and mailing the same, postage prepaid, shall constitute "rendering a bill." Neither the nonreceipt of any bill nor its misplacement, loss or destruction before payment shall constitute a basis for any extension of time in which to make payment thereof. Such bills shall be payable at the office of the finance director in the City Hall at 5275 Orange Avenue, Cypress, California 90630.

§ 22-4. Failure to pay charges.

In the event any bill is not paid within 45 days after the rendering thereof, there shall be added to the amount otherwise due and payable a penalty in an amount equivalent to 10% of said amount otherwise due and payable. Thereafter, for each additional period of 30 days during which a delinquent account remains payable, there shall be added to the amounts otherwise payable (including the aforesaid penalty) an additional penalty equal to one-half of one ( 1/2 of 1) percent of said amount otherwise payable.

In the event that any person shall fail to pay any charge herein provided when the same becomes due, the city may, in addition to any other remedies available to it, cut off any of said services and facilities referred to in this chapter, and need not resume the same until all delinquent charges and penalties, together with any charges necessitated by the resumption of such services and facilities, have been fully paid. As a condition precedent to the resumption of such services and facilities, the city may require the payment of a deposit of up to twice the estimated charges for a quarter.

§ 22-5. Charges for nonresidents.

Where the city furnishes to nonresidents, or to businesses located outside its boundaries, services and facilities in connection with its sanitation and sewerage system, the charges for such services and facilities are hereby fixed at double those made for furnishing said services and facilities to residents, as provided for hereinabove.

§ 22-6. Sanitation fund created.

There is hereby created a fund which shall be known as the sanitation fund. All moneys collected pursuant to the charges herein fixed shall be placed in said fund. Said fund shall be used only for such purposes as are permitted by law.

§ 22-10. Sewer design and construction standards.

(a) The provisions of Chapter 25, "Subdivisions," and specifically sections 25-28 and 25-29 of the Code of the City of Cypress shall apply to the design and construction of all sewer systems within the City of Cypress. Such sections shall apply to the design and construction of sewer systems within the City irrespective of the fact that the design or construction of the sewer is or is not required as a result of a subdivision of real property.

(b) Pursuant to article VIII of chapter 13 of this Code, the city, through its director of the department of public works, or his or her designee, shall promulgate design criteria, standards, and procedures to assure implementation of the requirements of such article, and to further promulgate design criteria, standards, and procedures so as to control infiltration and connections from inflow sources, including satellite systems, of the city's sanitary sewer system, and to require that sewers, sewer connections, and service laterals be designed and constructed so as to assure implementation of the requirements of such article, and to further promulgate design criteria, standards, and procedures for, and to inspect the construction of, all sewers, sewer connections, and service laterals to insure correct installation, testing, and inspection of all new and rehabilitated sewers, sewer connections, and service laterals so as to assure implementation of the requirements of such article.
