9.08.010 Drinking in public places.¶
(1) No person shall consume any malt, spirituous or vinous liquor containing more than one-half of one percent of alcohol, by volume, while he is upon any public street, alleyway, sidewalk or parkway, or in any public building, public park, public lavatory, auto park, or lobby or entranceway to any building within the city.
A violation of this section shall be an infraction and, upon a conviction thereof, shall be punishable by a fine of $65.00 per offense, plus assessment fees to be determined by the court.
(2) Exceptions. Alcohol consumption may occur at any public building or public park in conjunction with a city-sponsored or hosted special event, with the written approval of the city manager and subject to the following conditions:
(a) Non-alcoholic beverages and water must be available at the event.
(b) Alcoholic beverages may be sold or served on the following days and times:
(i) 9:00 a.m. to 10:00 p.m. from Sunday through Thursday;
(ii) 9:00 a.m. to 11:00 p.m. on Friday and Saturday, and for any federal, state, and/or city-designated holiday. Regardless of whether the event coincides with the holiday date, these hours still apply.
(c) All alcoholic beverage sales shall end a minimum of 30 minutes before the scheduled event ends.
(d) All alcoholic beverages must be consumed within a marked designated area and wristbands shall be given to attendees 21 years of age and older.
(e) A detailed security plan approved by the sheriff’s department is on file.
(f) The sheriff’s department has the power to determine if the presence of a city-approved doorman and/or security personnel is required.
(g) Approval from the state Department of Alcoholic Beverage Control is required. (Ord. 743 § 2, 2024; Ord. 401 § 1. 2002 Code § 5-1).
9.08.020 Setups.¶
No person shall serve “setups” between the hours of 2:00 a.m. and 6:00 a.m. if they are to be used with distilled spirits. (2002 Code § 5-2).
9.08.030 Alcoholic beverages on school grounds.¶
No person shall consume any alcoholic beverage on the grounds of any public school or in any stadium or athletic field while being used by a public school. (2002 Code § 5-3).
9.08.040 Drinking in vehicles.¶
No person shall enter or remain in a vehicle while any other occupant is consuming any alcoholic beverage while such vehicle is on a public street. (2002 Code § 5-4).
9.08.050 Consuming liquor on streets or highways.¶
Every person who goes upon or remains upon any part of a public street or highway while he is consuming any alcoholic beverage shall be guilty of a misdemeanor. (2002 Code § 5-5).
9.08.060 Consuming liquor in vehicles on streets.¶
Every person who enters or remains in any vehicle while such vehicle is on any part of a public street or highway when such person or any other occupant of such vehicle is consuming any alcoholic beverage shall be guilty of a misdemeanor. (2002 Code § 5-6).
