The purpose of this chapter is to protect the environment from the negative impacts of plastic bags by restricting stores from distributing plastic bags, as declared by the Legislature in California Public Resources Code Section 42279.

The provisions of the California Public Resources Code Sections 42279 through 42288, or as may be amended, are hereby adopted by reference in this chapter. Stores and other entities covered by these state laws are subject to the definitions, requirements, prohibitions, and penalties set forth therein.

(a) Civil Penalties. Pursuant to the California Public Resources Code Section 42285, the town may impose civil liability on any person or entity that knowingly violated or reasonably should have known it violated any provision of this chapter or the California Public Resources Code Sections 42279 through 42288 in the amount of one thousand dollars per day for the first violation of this chapter, two thousand dollars per day for the second violation, and five thousand dollars per day for the third and subsequent violations.

(b) Administrative Penalties. Violations of this chapter shall be subject to administrative citations as provided in Chapter 9.05 of this code.
