82.20.010 Dedications generally.

Subject to the other provisions of this title, the City Council may require, as a condition precedent to the approval of a Lnal or parcel map, that the subdivider dedicate or irrevocably oOer to dedicate real property within the subdivision for streets, alleys, access rights, abutter’s rights, drainage, public utility easements and other public easements. 82.20.020 Dedication procedure.

A. All dedications or oOers of dedication required by the provisions of this title shall be by certiLcate on the Lnal or parcel map.

B. An oOer of dedication shall be in such terms as to be binding on the owner, his heirs, assigns, or successors in interest, and except as provided in Section 66477.2 of the Act, shall continue until such dedication is accepted or the oOer is abandoned or otherwise terminated. Any such dedication or oOer of dedication shall be free of any burden or encumbrance which would interfere with the purposes of which the dedication or oOer of dedication is required.

C. The subdivider shall provide a current preliminary title report or equivalent proof of title satisfactory to the City Engineer.

D. At the time the City Council approves the Lnal or parcel map, it shall also accept, accept subject to improvement, or reject any oOer of dedication. The City Clerk shall certify on the map the action taken. The City Engineer is authorized to act on behalf of the City Council in rejecting or accepting dedications. (Gov. Code § 66477.1)

82.20.030 Dedication of streets.

A. The subdivider shall oOer to dedicate rights-of-way for streets within the subdivision in accordance with the City standards.

B. No Lnal or parcel map shall be approved unless the street or streets providing primary access to the subdivision are dedicated to and maintained by the City, a County or State and the street or streets meeting City standards.

C. Streets which are proposed on the boundaries of a subdivision shall have a dedicated width of no less than 80 feet together with a strip of land one foot wide on its outer edge which shall be oOered to the City for street purposes and over which access rights are relinquished.

D. All streets proposed to be terminated at the subdivision boundary shall include a strip of land one foot wide across said street at its point of termination at said boundary which shall be portions of the adjacent lots, oOered for street purposes and over which access rights are relinquished.

E. Where it is necessary to extend a street beyond the boundaries of a subdivision to provide adequate circulation for residents of the subdivision, the subdivider shall cause the required easements to be dedicated to the City and shall improve said easements in accordance with City standards.

F. The City Engineer may impose a requirement that any dedication or oOer of dedication of a street shall include a waiver of direct access rights to such street from any property shown on the Lnal or parcel map as abutting thereon, and that if the dedication is accepted, such waiver shall become eOective in accordance with the provisions of the waiver of direct access. (Gov. Code § 66476)

82.20.040 Reservation of area for public use.

The City Council may require that areas of real property within the subdivision be reserved for parks, recreational facilities, Lre stations, libraries or other public uses in accordance with Sections 66479 through 66482 of the Act.
