5.44.010 Definitions.¶
(A) "Garage sale" means all general sales, open to the public, conducted from or on a premises in any residential or mobile home zone for the purpose of disposing of personal property, including, but not limited to, all sales entitled, advertised or called "garage," "lawn," "yard" "attic," "porch," "room," "backyard," "patio," "flea market" or "rummage" sale. This definition does not include the holding out for sale of five or less specific items when all advertisement thereof specifically denominates them.
(B) "Personal property" means property which is owned, utilized or maintained by an individual or members of his or her residence or family and acquired in the normal course of living in or maintaining a residence. It does not include merchandise which was purchased for resale or obtained on consignment.

5.44.020 Exemptions.¶
The provisions of this chapter shall not apply to the following:
(A) Persons selling goods pursuant to court order;
(B) Persons acting in the scope of their powers and duties as public officials;
(C) Any bona fide charitable, educational or cultural institution or organization, when the proceeds from the sale are used directly for charitable, educational or cultural purposes.

5.44.030 Merchandise.¶
It is unlawful for any individual to sell or offer for sale, under authority granted by this chapter, property other than personal property.

5.44.040 Permit – Required.¶
No garage sale shall be conducted without first obtaining a permit from the city and conforming to the regulations as provided in this chapter.

5.44.050 Permit – Application.¶
(A) To obtain a permit to conduct a garage sale, the applicant must file a written application for a permit with the city prior to the sale. The application shall set forth:
(1) The name and address of the applicant;
(2) The location of the proposed sale;
(3) The date or dates during which the sale will be conducted;
(4) A summary inventory of the personal property to be offered for sale;
(5) An affidavit or declaration under penalty of perjury that the person or persons conducting the sale are the owners of the property offered for sale;
(6) The number of times during the preceding 12 months and the dates that the applicant has conducted a garage sale on the premises.
(B) The City Council may by resolution condition issuance of such permit upon payment of a reasonable fee.

5.44.060 Permit – Issuance.¶
(A) Upon receipt of the applicant properly executed any permit fee due, a permit shall be issued providing:
(1) The name of the applicant and street location of sale;
(2) The dates upon which the sale shall be conducted;
(3) The serial number of the permit issued.
(B) No more than three such permits may be issued to one applicant or residence during any calendar year. If members of more than one residence join in requesting a permit, such permit shall be deemed issued for each and all such residences. No permit shall be transferable to another person or premises. Before issuing a permit, a police officer or other official designated by the city may conduct an investigation to determine if there is compliance with the provisions of this chapter.

5.44.070 Permit – Denial – Revocation.¶
Any permit issued pursuant to this chapter may be revoked or any application for issuance of a permit may be refused if the application for the permit contains any false, misleading or fraudulent statement. Any individual convicted of an offense under this chapter shall suffer cancellation of any existing permit and shall not be issued another permit for a period of two years from the time of conviction.

5.44.080 Permit – Posting.¶
It is unlawful for any permittee to conduct a sale as provided in this chapter unless a valid permit is posted in a location on the premises visible from the nearest public street and during all time that the sale is in progress.

5.44.090 Hours of operation.¶
Garage sales shall be limited in time to no more than the daylight hours of three consecutive days or two consecutive weekends (Saturdays and Sundays). All personal property placed in public view for a garage sale shall be removed from public view at the close of the sale.

5.44.100 Signs.¶
(A) Only the following signs may be displayed in relation to a garage sale:
(1) No more than two signs of not more than four square feet each may be displayed on the premises where the garage sale is being conducted;
(2) Two signs of not more than two square feet each may be displayed off the premises, provided the permission to erect the signs is received from the property owners upon whose property the signs are being placed.
(B) No sign shall be exhibited for more than two days prior to the day such sale is to commence. All signs shall be removed at the close of the sale.
(C) As provided in § 17.74.070(I), no sign shall be placed in the public right-of-way.

5.44.110 Violation – Penalty.¶
Any person who violates any of the provisions of this chapter shall be deemed guilty of an infraction.
