Chapter 16.34 — AMENDMENT OF FINAL MAPS

16.34.010 Purpose.

The purpose of this chapter is to provide authority and procedure for the modification of a recorded final map or recorded parcel map, including modification of conditions. Said modifications may be made by a certificate of correction or an amending map as approved by the city.

16.34.020 Filing of application.

An application for a modification to a recorded final map or recorded parcel map shall set forth the nature and extent of the requested modification and all facts upon which the request is based.

16.34.030 Fees.

Fees shall be paid at the time of the filing of an application for modification in an amount established by resolution of the City Council.

16.34.040 Notice of public hearing.

Any such application for modification shall be set for public hearing as provided for in California Government Code Section 66451.3.

16.34.050 Public hearing — Council action.

The City Council shall hold a public hearing on the requested modification. The hearing may be continued at the Council's discretion. Upon the conclusion of the public hearing, the council may, by motion, approve or deny the application, or approve the application with modifications.

16.34.060 Findings.

The Council may not approve a proposed modification unless each of the following findings are made with supporting evidence:

(A) That there are changes in circumstances which make any or all of the conditions of the final map or parcel map no longer appropriate or necessary; and

(B) That the modifications do not impose any additional burden on the present fee owner of the property; and

(C) That the modifications do not alter any right, title, or interest in the real property reflected on the recorded map; and

(D) That none of the conditions set forth in Government Code Section 66474 applies to the map as modified. (`78 Code, § 16.34.060.) (Ord. 1846 § l (part), 1987.)
