6.16.010 - Definitions.

For the purposes of this chapter, the following words, terms and phrases shall have the meaning herein as follows:

"Director" means the director of the community development department of the city.

"Person" means an individual, partnership, firm, corporation, committee, association or any other organization or group. "Person" does not include a city, a county, a sanitation district or other public agency.

"Solid waste" means all putrescible and nonputrescible solid, semisolid and liquid wastes, including garbage, trash, refuse, paper, rubbish, ashes, industrial wastes, including oilfield wastes, demolition and construction wastes, abandoned vehicles and parts thereof, discarded home and industrial appliances, manure, vegetable and animal solid and semisolid wastes, and other discarded solid and semisolid wastes.

"Solid waste disposal facility" means a privately owned or operated facility for the purpose of final disposal of solid waste onto land, which is located within two hundred fifty miles of the city.

"Solid waste hauling service" means a business enterprise, in any form, whose purpose is the collection and transportation to a solid waste disposal facility of solid wastes from residential, commercial, institutional or industrial users or customers.

6.16.020 - Prohibition.

(a) No person holding an exclusive franchise from the city to provide solid waste hauling services in the city shall dispose of, or tender for disposal, any solid waste at a solid waste disposal facility which is under the ownership or control of the person who owns or controls that solid waste hauling service.

(b) No person carrying on the business of a solid waste disposal facility shall dispose of, or receive for disposal, any solid waste from a solid waste hauling service holding such an exclusive franchise which is under the ownership or control of the person which owns or controls that solid waste disposal facility.
