Chapter 6.14 — REFUSE-TO-ENERGY PLANT

6.14.010 - Refuse defined.¶
For the purpose of this chapter, "refuse" means all waste material, including waste material of animal, vegetable and mineral composition, subject to combustion, putrefaction or disintegration by oxidation and shall include waste metal and glass, but shall not include common earth or rock aggregate compounds; however, scrap materials which are source separated for collection and processing as industrial raw materials shall not be considered "refuse" except when contained in the "refuse."

6.14.020 - Disposal facility designated—Required use.¶
The Commerce refuse-to-energy authority cogeneration plant is designated as the disposal facility for all or certain portions of all refuse collected within the city. Upon the plant's availability for use, the city shall determine whether all or certain portions of such refuse must be disposed of only at the plant. Following such determination, all refuse haulers licensed by the city shall thereafter dispose of all refuse so designated at the plant.

6.14.030 - Rates to be competitive.¶
Rates charged by the Commerce refuse-to-energy authority for the disposal at its cogeneration plant shall be competitive with costs of disposal at competing sites, taking into consideration the average mileage to said plant as opposed to the average mileage to the then existing competing facilities, the tipping fee charged at the authority's plant as opposed to the average tipping fee charged at available competing sites and any other factors which materially affect the cost of disposal to the collector thereof. Notwithstanding the foregoing, nothing herein shall be construed as: (a) limiting the authority's power to charge tipping fees in amounts required by the terms of the resolution issuing bonds for the construction of the plant; or (b) excusing any licensed refuse hauler from the requirement of disposing of all or portions of all refuse collected within the city in accordance with Section 6.14.020 hereof.
