Chapter 5 — BICYCLES

Article I. - In General.

Sec. 5-1. - Bicycle—Defined.

A "bicycle" for purposes of this chapter shall mean every device upon which a person may ride, propelled wholly or in part by muscular power, having two or more tandem wheels, any one of which is fourteen inches in diameter or greater.

Sec. 5-2. - Licenses—Required.

It shall be unlawful for any person to operate or use a bicycle upon any of the streets, alleys or public highways in the City without first obtaining from the police department a license therefor.

Sec. 5-3. - Licenses—Issuance.

The police department shall issue, upon a written application provided by the police department, licenses which, when issued, shall entitle the licensee or his nominee to operate such bicycle for which the license has been issued upon all the streets, alleys and public highways, exclusive of sidewalks, in the city as long as the licensee is the owner of such bicycle.

Sec. 5-4. - Licenses—Issuance—Records.

The police department shall keep a record of the date of issuance of such bicycle license, to whom issued, and the number thereof.

Sec. 5-5. - Licenses—Plates and registration cards.

The city shall provide licenses and registration cards for bicycles licensed pursuant to the provisions of this chapter. The license shall be suitable for attachment upon the frame of a bicycle, and the police department shall attach one such license plate to the frame of each bicycle and issue a corresponding registration card to the licensee upon payment of the license fee set forth in section 5-7 of this chapter. Such license shall remain attached during the existence of such license.

It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to the provision of this chapter. It shall also be unlawful for any person to remove, destroy, mutilate or alter any license plate or registration during the time such license plate or registration card is operative; provided, however, the provisions of this section shall not prohibit the police

department from stamping numbers or other identifying marks on the frames of bicycles on which no serial number can be found or on which the number is illegible or insufficient for identification purposes.

Sec. 5-7. - Licenses—Fees.

The amount of the license fee and the fee for the transfer of ownership as prescribed in this chapter shall be set from time to time by resolution of the city council.

Sec. 5-8. - Transfer of ownership—Registration.

Every person who sells or transfers the ownership of any bicycle shall report such sale or transfer by returning to the police department the registration card issued to such person as the licensee thereof, together with the name and address of the person to whom the bicycle was sold or transferred. Such report shall be made within five days after the date of such sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration therefor within five days after such sale or transfer.

Sec. 5-9. - Dealers—Reports.

All persons engaged in the business of buying secondhand bicycles shall make a report to the police of all purchases of secondhand bicycles made by such dealers, which report shall include the name and address of each person from whom a bicycle is purchased, the description of each bicycle purchased, the frame number thereof, if any, and the number of the license tag found thereon, if any. All persons engaged in the business of selling new or secondhand bicycles shall make a report to the police department of all sales made by such dealers, which report shall include the name and address of each person to whom the bicycle is sold, the kind of bicycle sold, a description thereof, the frame number, if any, and the number of the license tag attached thereto, if any. The reports required by the section shall be made within five days after each such purchase or sale.

Sec. 5-10. - Operating restrictions.

(a)

Riding on sidewalk. No person shall ride a bicycle upon any sidewalk or walkway in a business district within the city. For purposes of this section, "business district" shall be defined as any public sidewalk which borders any commercial building.

(b)

Passengers. It shall be unlawful for any person to ride any bicycle upon any public right-of-way while carrying a passenger unless such bicycle has been specifically built to carry such passengers.

(c)

Clinging. It shall be unlawful for any person while operating or riding a bicycle to attach himself or his vehicle to any other moving vehicle or person in any other moving vehicle.

(d)

Racing. It shall be unlawful for any person to ride or operate any bicycle upon any public right-of-way while participating in any race, speed or endurance contest unless such contest has the specific permission of the chief of police and is under proper supervision.

Parking. It shall be unlawful for any person to park any bicycle on or in any public right-of-way so as to in any way present an obstruction or a hazard to any pedestrian, traffic, vehicle or property.

Sec. 5-11. - Impoundment of bicycles.

In addition to any penalty imposed for a violation of this chapter, the court may order the police department to impound and retain possession of any bicycle operated in violation of this chapter, and to retain possession of same until the license as provided for in this chapter is obtained by the owner of the bicycle.

Sec. 5-12. - Violation—Penalties.

Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished as set forth in chapter 1, section 1-7, of this code.
