Sec. 3-2. - Permit—Required.¶
It is unlawful for any person to hold or conduct any public dance, exhibition, carnival or public entertainment to which attendance by the general public is invited or solicited in the city whether or not a charge for admission is made, without first obtaining a valid permit from the chief of police.
Prior to issuing the permit, the chief of police shall inform himself of the circumstances surrounding the proposed public dance, exhibition, carnival or entertainment. In the event the chief of police does not deem it in the best interests of the city that such permit be issued, he shall have the discretion to deny the application for the permit.

Sec. 3-3. - Same—Application.¶
Any person, firm, corporation, club, school, organization or association desiring to hold or conduct a public dance, exhibition, carnival or public entertainment in the city shall file an application with the chief of police for a permit to hold such public dance, exhibition, carnival or public entertainment not less than seven days prior to the date of such public dance, exhibition, carnival or public entertainment. The application shall be on a form prescribed by the chief of police and shall set forth the following:
(a) The name of the person, firm, corporation, club, school, organization or association holding or conducting the public dance, exhibition, carnival or public entertainment.
(b) The date, time and place of the public dance, exhibition, carnival or public entertainment.
(c) The amount of admission charge, if any.
(d) The type of music to be played at the public dance, exhibition, carnival or public entertainment (live instrumental or recorded), and whether amplifiers will be used.
(e) The number of persons expected to be in attendance at the public dance, exhibition, carnival or public entertainment.
(f) Such other additional information as may be reasonably required by the chief of police to enable him to process the application.

Sec. 3-4. - Special requirements.¶
Before issuing the permit, the chief of police shall require the applicant to exhibit to him signed receipts showing that all business licenses, taxes, fees, reimbursements and deposits, if any, as may be required by the city under sections of this Code have been paid. The chief of police may also require as a condition to the issuance of the permit that such number of police officers as he may deem necessary be assigned to be in attendance during the conduct of the public dance, exhibition, carnival or public entertainment in order to maintain law and order and prevent disturbances of the peace at or about the premises where the public dance, exhibition, carnival or public entertainment is held. Such special police officers shall be selected, employed by and act under the direction of the chief of police. The applicant before being granted a permit pursuant to this section, shall deposit with the city clerk the cost to be incurred by the city for employing such special officers at such rate of pay as may be determined from time to time by the city council. If during the conduct of any such public dance, exhibition, carnival or public entertainment, circumstances arise whereby the chief of police deems it necessary to employ additional special officers for the purposes herein set forth, the chief of police may employ such additional special police officers and the cost of such additional police officers shall be paid by the permittee.
As an alternative to the selection and employment of such special police officers by the chief of police, the applicant may employ licensed, bonded private security police. The number and identity of such private security police shall be approved by the chief of police and they shall act under the direction of the chief of police. The cost of employing private security police shall be paid by the applicant to the private security police organization. If such private security police are employed in accordance herewith, no deposit of funds with the city clerk shall be necessary.
All premises where public dances, exhibitions, carnivals and public entertainments are conducted shall be closed at or before 2:00 A.M., and no person shall permit any public dance, exhibition, carnival or other public entertainment to be conducted or carried on between the hours of 2:00 A.M. and 8:00 A.M. of the same day.

Sec. 3-5. - Revocation of permit.¶
Any permit issued by the chief of police for a public dance, exhibition, carnival or public entertainment may be summarily revoked by the chief of police if such public dance, exhibition, carnival or public entertainment is conducted in such a manner as to be detrimental to the safety and welfare or public health of the public.

Sec. 3-6. - Penalty for violation of article.¶
Any person violating any of the provisions of this article or knowingly or intentionally misrepresenting to any officer or employee of the city any material fact in procuring the permit herein provided for, shall be deemed guilty of a misdemeanor. Each day's operation without such a permit is a separate violation.

Sec. 3-7. - Appeal to the city council.¶
In the event the applicant for the permit is dissatisfied with any action taken or decision made by the chief of police, said applicant may appeal to the city council and the city council shall have authority to affirm, modify or over-rule such action or decision of the chief of police.
