Coachella Municipal Code Ch. 8.08 Agricultural Enterprise Protection for Augustine East Annexation Area

It is the historically demonstrated policy of the city to encourage and assist the agricultural enterprises which surround the city, just as agriculture provides jobs for many of our citizens. Furthermore, the city has drafted a comprehensive zoning and land use plan which seeks to preserve the agricultural lifestyle of our community. In an effort to find the means for a harmonious coexistence between urban and rural land uses, this chapter shall be on an experimental basis, for application only to the Augustine East annexation area, where it shall remain in effect as long as agricultural operations continue. This chapter shall not be construed as an attempt to modify, abridge or supersede any applicable federal, state or county laws.

The city shall impose no assessments, of any kind. This general exemption shall continue as long as the land remains in agricultural use. Existing nonfarm housing shall also be exempt

The city has no present intention to change zoning or land use designations without the request or consent of the landowners.

No commercial agricultural enterprise, operation or facility, or any related activity or appurtenances, shall be or become a nuisance, public or private, as a result of any changed circumstances in or about the locality thereof after the same has been in operation for more than two years, if such action was not a nuisance at the time it began, provided that the conduct of the agricultural operation is consistent with customs and standard as established and followed by other similar agricultural operations in the same locality.
