Editor's note— Ord. No. 1131, § 1, adopted Jan. 23, 2019, repealed the former Ch. 5.64, §§ 5.64.010—5.64.100, and § 2 of the same ord. enacted a new chapter as set out herein. The former Ch. 5.64 pertained to similar subject matter and derived from Ord. 980, § 1(part), adopted in 2007.

The city of Coachella has a substantial interest in promoting compliance with federal, state, and local laws intended to regulate tobacco sales and use; in discouraging the illegal purchase of tobacco products by a person under twenty-one (21) years of age; in promoting compliance with laws prohibiting sales of cigarettes and tobacco products to a person under twenty-one (21) years of age; in protecting youth from being lured into illegal activity through the misconduct of adults; and in reducing the incidence of tobacco related disease. It is the intent of this chapter to encourage responsible tobacco retailing and to discourage violations of tobacco related laws, especially those that prohibit or discourage the sale or distribution of tobacco products to a person under twenty-one (21) years of age, but not to expand or reduce the degree to which the acts regulated by federal or state law are criminally proscribed or to alter the penalty provided therefore.

Ordinance No. 838 (as amended by through 838.2) of the Riverside County Board of Supervisors as it existed effective August 25, 2016, attached hereto as Exhibit A and now on file in the office of the City Clerk, is hereby adopted as the Permitting of Tobacco Retailers Code of the City.
