1.08.010 - General penalty.

A. It is unlawful for any person to violate, or fail to comply with, any of the requirements of this code or the provisions of any code adopted by reference by this code, or any provision of any ordinance of the city not included within this code. Any person violating any such provisions or failing to comply with any of the mandatory requirements of this code, or any code adopted by reference by this code, or any other city ordinance, shall be guilty of a misdemeanor, unless the violation is specifically designated as constituting only an infraction. Any violation charged as a misdemeanor may be reduced to an infraction for good cause at the discretion of the city prosecutor.

Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this code, or any provision of any code adopted by reference by this code, or of any other city ordinance, is committed, continued, maintained, allowed, or permitted by such person, and may be punished accordingly.

B. Except in cases where a different penalty is prescribed by any ordinance of this city, any person convicted of an infraction for violation of an ordinance of the city is punishable by a fine not exceeding one hundred dollars ($100.00) for a first violation, a fine not exceeding two hundred dollars ($200.00) for a second violation of the same section of this code within one year, and a fine not exceeding five hundred dollars ($500.00) for a third violation of the same section of this Code within one year. A fourth violation, and all subsequent violations, of the same section of this Code within one year shall be prosecuted as a misdemeanor and shall be subject to a fine not exceeding one thousand dollars ($1,000.00) and up to six months imprisonment per violation.

C. Except in cases where a different punishment is prescribed by any ordinance of the city, any person convicted of a misdemeanor for violation of an ordinance of the city is punishable by a fine of not more than one thousand doollars ($1,000.00) or by imprisonment in the county jail not to exceed six months, or by both such fine and imprisonment.

1.08.020 - Working of prisoners.

A. Any person imprisoned for the violation of any ordinance of the city may be required to perform labor on the streets, public works, or public property within the city.

B. Such labor shall only be required to be performed as directed by the chief of police and no prisoner shall be required to labor for more than eight hours during any twenty-four (24) hour period of his or her imprisonment.

1.08.030 - Emergency order enforcement.

A. Violation Unlawful. It is unlawful and declared a public nuisance for any person to violate any emergency order made by the Governor of the State of California under the Emergency Services Act or any order of the State Department of Public Health or Riverside County Health Officer issued for the purpose of preventing the spread of any contagious, infectious, or communicable disease.

B. Remedies. The city may enforce this chapter using any remedy available under the law, including:

  1. Issuance of an administrative citation under Chapter 3.20 of this Code.

  2. Denial, nonrenewal, suspension, or revocation of a business license under Chapter 5.04 of this code.

  3. Suspension or revocation of any conditional use permit under Section 17.74.050 of this Code, revocation of legal nonconforming status under Section 17.78.040 of this Code, or suspension or revocation of other land use approval under Title 17 of this code.

  4. Misdemeanor criminal prosecution by the city prosecutor under Section 1.08.010 of this code.

  5. Punishable as provided under Section 2.56.100 of this code.

  6. Filing of a civil or equitable action to seek abatement of any violation.

C. Violations Ongoing. Each and every day a violation is maintained, caused, aided, abetted, concealed, suffered, or permitted is a separate offense.

D. Remedies Cumulative. The remedies, procedures, and penalties provided by this section are cumulative to each other and to any other available under city, state, or federal law.
