2-9.1 Planning Agency Established.

Pursuant to Government Code Sections 65000 et seq., there is hereby established a Planning Agency consisting of a Planning Commission and a Department of Planning and Community Development. (Ord. #7, S1)

2-9.2 Planning Commission: Appointment and Term of Office of Members.

A Planning Commission was created February 1981 for the City of Clearlake and shall continue. The Planning Commission shall consist of five (5) members who reside within the boundaries of the City of Clearlake. They shall be appointed by the City Council. Thereafter, all terms shall be for four (4) years and shall expire four (4) years after the effective date of the appointment, except those appointments made after the commencement of the term to fill a vacancy or removal, in which case the term of office shall be for the balance of the unexpired term. 2-9.3 Members: Removal from Office.

A member of the Planning Commission may be removed by a majority vote of all the members of the City Council. A member who fails, without permission, to attend three (3) successive meetings of the Commission is subject to removal. (Ord. #7, S3)

2-9.4 Vacancies.

A vacancy on the Planning Commission occurring by death, resignation, removal, or any other cause before the unexpired term of the member shall be filled by appointment for the expired term by the City Council. (Ord. #7, S4)

2-9.5 Salary and Expenses.

In accordance with Government Code 65101 Planning Commissioner salary shall be seventy-five ($75.00) dollars per month, effective April 1, 2019. In addition, Planning Commission members shall be entitled to reimbursement for expenses as the City Council may approve. (Ord. #7, S5; Ord. #9, S1; Ord. #225-2019, S2)

2-9.6 Chairman; Meetings; Rules and Records.

a. Chairman. The Planning Commission shall annually elect a Chairman and Vice Chairman from its membership. In the absence or disability of either the Chairman or Vice Chairman, the Commission may designate a temporary Chairman or Vice Chairman.

b. Meetings. The Commission shall hold its regular meetings at 6:00 p.m. on the first and third Tuesday of each month and shall hold additional meetings as may be necessary. The Commission may cancel any regular meeting provided that at least seventy-two (72) hours prior to the date of the meeting to be canceled a Notice of Cancellation shall be posted in the same manner and location(s) as the posting of its regular meeting agendas.

c. Rules and Records. The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations. The rules shall provide, in the case of the matters set forth in subsection 2-9.7, paragraphs a. and e., and in the case of amendments to either the general plan or zoning ordinance, that not less than three (3) affirmative votes shall be required to recommend matters to the City Council for adoption. 2-9.7 Planning Commission Powers and Duties.

The Planning Commission shall have the power and it shall be its duty:

a. To prepare and recommend for adoption by the City Council a comprehensive long term general plan for the physical development of the City and of any land outside its boundaries which in the Planning Commission’s judgment bears relation to its planning.

b. To prepare specific plans based on the general plan and drafts of such regulations, programs and legislation as may in its judgment be required for the systematic execution of the general plan, and to recommend such plans and measures to the Council for adoption.

c. To act as the advisory agency for the City in connection with the administration of the Subdivision Map Act of the State and the City’s subdivision regulations.

d. To perform the duties of a planning commission as prescribed by law including those duties prescribed by Articles 7, 8, 9 and 10 of Chapter 3, Title 7 and Article 3, Chapter 4, Title 7 of the Government Code of the State of California as now existing or hereafter amended.

e. To prepare and recommend for adoption by the Council a zoning ordinance and to perform such other duties in reference to planning and zoning and land use matters as may be required by the Council. (Ord. #7, S7)

2-9.8 Department of Planning and Community Development; Director.

The Department of Planning and Community Development of the City of Clearlake is hereby created. The Department of Planning and Community Development shall be managed by a Director who shall be appointed by the City Council, and who shall be subject to the general administrative direction of the City Manager. The Director, subject to the approval of the City Manager, may organize and maintain such divisions in the department as in his/ her judgment the operation may require and shall be responsible for the direction and control of all functions assigned to the department. In the absence or disability of the Director, the City Manager shall designate a person to perform the duties and exercise the powers of the Director. (Ord. #7, S8; Ord. #73-96, S1; Ord. #2012-153)

2-9.9 Director’s Powers and Duties.

The Director of Planning and Community Development shall have the following powers and duties:

a. To provide staff assistance to the Commission and serve as its secretary or designate a member of his staff to serve as secretary to the Commission. Before the appointment of the first Director or subsequently if necessary, the Commission shall designate one of its own members to act as Secretary.

  • b. To provide staff assistance to the Manager and Council.

  • c. To make surveys, gather data, prepare reports, maps, charts and graphic presentations pursuant to the preparation, presentation, adoption and revision of a general plan.

  • d. To enforce the planning and zoning laws of the State of California and ordinances of the City.

  • e. To conduct the City’s environmental review process in accordance with the State Environmental Quality Act.

  • f. To manage and/or coordinate all City matters concerning housing and commercial buildings. (Ord. #7, S9; Ord. #2012-153)
