9.14.010 - Definitions.

For the purposes of Sections 9.14.020 through 9.14.050, the following words and phrases shall have the meanings respectively ascribed to them by this section:

A. "Intoxicating beverage" means and includes alcohol, spirits, liquor, wine, beer and every liquid or solid containing alcohol, spirits, wine or beer and which contains more than one-half of one percent of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances.

B. "Public place" means and includes any street, alley, sidewalk, parkway, off-street parking area or park and including the city hall, police station and fire station in the city and the grounds about the same or other public place within the city.

9.14.020 - Intoxication in Public Place Prohibited.

It is unlawful for any person to appear at or be in any public place or any place open to public view in the city in a state of drunkenness or intoxication or under the influence of intoxicating beverages.

9.14.030 - Drinking Intoxicating Beverage in Public Place Prohibited.

Any person drinking or consuming any intoxicating beverage in or upon any public place or going in or upon any part of any public place while he is drinking or consuming any intoxicating beverage shall be guilty of a misdemeanor, unless such activity as described herein occurs at a time and in an area which is specifically designated and authorized by permit issued by the chief of police.

9.14.040 - Entering Vehicle While Intoxicated or While Drinking Intoxicating Beverage Prohibited.

Any person entering or remaining in or upon any vehicle while such vehicle is on any part of any public street or any other public place when such person is drunk or under the influence of any intoxicating beverages or is drinking or consuming any intoxicating beverages shall be guilty of a misdemeanor.

9.14.050 - Creating Nuisance on Private Premises Prohibited.

It is unlawful for any person to create a nuisance on any private premises as a result of drunkenness or intoxication or the use of narcotic.
