6.05.010 - Keeping Prohibited Animals—Exception.¶
A.
Except as otherwise permitted in accordance with Title 17 of this Code, it shall be unlawful for any person to keep, maintain, possess, or harbor on any property within the city without a permit any animal determined to be dangerous or potentially dangerous under Article 416-12.4 of the Contra Costa County Code. It shall also be unlawful to keep, maintain, posses or harbor on any property within the City, any apiary, reptiles, livestock, or fowl, including, but not limited to, horses, mules, donkeys, burros, cattle, sheep, goats, swine, pigs, rabbits, chickens [2], geese, ducks, turkeys, doves, or pigeons. [3] The owner or possessor of property on which animals are lawfully kept shall provide facilities which will reasonably assure that the premises will be maintained in a sanitary condition, free from offensive odors, excessive noise, or any other conditions which constitute a public nuisance as defined in Section 8.08.010 of this Code.

6.05.020 - Wild, Exotic, Dangerous or Potentially Dangerous Animals.¶
A.
Unless the registration provisions of Chapter 416-11 of the Contra Costa County Code have been complied with or a permit has been obtained under Article 416-12,4 of the Contra Costa County Code, it is unlawful for any person to hold, possess, maintain, harbor, transport, or sell within the city any living wild, exotic, or unpermitted dangerous or potentially dangerous animal.
B.
The term "wild, exotic, dangerous or potentially dangerous animal" for the purpose of this section means any of the following:
Any animal described in California Fish and Game Code §§ 2116 and 2118;
Any animal described in any addition to Fish and Game Code § 2118 by regulation of the Fish and Game Commission as provided in Section 2118(j);
Class Aves: (birds)
a.
Order Falconiformes (including, but not limited to, hawks, eagles, and vultures)
b.
Subdivision Ratitae (including, but not limited to, ostriches, rheas, cassowaries, and emus);
Class Reptilia: (snakes, lizards, turtles, alligators)
a.
Order Ophidia (including, but not limited to, racers, boas, water snakes, and pythons) over six (6) feet long;
b.
Order Loricata (including, but not limited to, alligators, caymans, and crocodiles) over twelve (12) inches long;
Any class, order, family, genera, or species of wild animals which may be designated by the Contra Costa County Animal Services Director as a menace to public peace, health or safety, or to native wildlife or agricultural interests, by written designation filed with the clerk of the Contra Costa County Board of Supervisors;
Any non-domestic species when kept, maintained, or harbored in such numbers or in such a manner as to create or constitute a nuisance or, in any event, a likelihood of danger to such animals, other animals, the environment, or the persons or property of human beings; and
Any species of animal, which is venomous to human beings, whether by bite, sting, touch, or otherwise, except honey-producing bees.
Any animal determined to be dangerous or potentially dangerous pursuant to Section 416-12.406 et seq. of the Contra Costa County Code.
