10.42.010 - Requirement for Permit.

No person shall drive a motor vehicle, including motorcycles and off-highway motor vehicles, on land belonging to or occupied by another, including publicly owned lands not established for normal vehicular travel, without having, and upon the request of a peace officer displaying, written permission from the owner of such lands or his or its agent, or the person in lawful possession of such lands duly authorized to grant such permission. This section shall not be applicable, however, to persons having visible, lawful business with the owner, agent or person in lawful possession.

10.42.020 - Noise Limits.

A.

No person shall operate any vehicle described in Section 10.42.010 on any land described in said section, at any time or under any condition, in such a manner as to exceed the following noise limit for the category of motor vehicle within the speed limits hereinafter specified:

1. Any motorcycle other than a motor-driven cycle. 82 dbA 86 dbA

2. Any other motor vehicle and any combination of vehicles 76 dbA 82 dbA towed by such motor vehicle.

B.

The noise limits established by this section shall be based on a distance of fifty (50) feet from the point of vehicle operation.

10.42.030 - Spark Arrester and Muffler Required.

No vehicle described in Section 10.42.010 shall operate upon any land mentioned in said section unless the same is equipped with an adequate muffler and spark arrester in constant operation and properly maintained, and no muffler or exhaust system shall be equipped with a cutout, bypass or similar device.

10.42.040 - Exception.

The provisions of this chapter shall not apply to heavy construction equipment lawfully operating upon private or public land, with the consent of the owner of the same, provided such equipment shall have mufflers, spark arresters or other such equipment as is otherwise required by state regulation or fire district rules.
