Chino Hills Municipal Code Ch. 12.46 Regulation of Government Center Parking Facilities

The City's Government Center parking structure and City-owned Government Center parking lots surrounding the Government Center ("Government Center Parking Facilities") are designed and intended solely for use by persons who are parking and retrieving vehicles, proceeding to or from parked vehicles, proceeding to or from Government Center buildings or for use by public employees and contractors. The City Council finds that there exists and has existed misuse of the Government Center parking structure, including crimes against persons or property, and for congregation of individuals that impedes traffic and parking flow. The City Council finds that such conduct is averse to the public peace, safety and welfare. The City Council further finds that it is in the best interest of the public safety and welfare to regulate the misuse of public property and to adopt the following regulations.

A. No person shall be present in the Government Center parking structure (which is the parking structure located directly north of City Hall) or the City-owned Government Center parking lots surrounding the Government Center ("Government Center Parking Facilities") unless he or she is:

1. Parking or retrieving a parked vehicle, or retrieving an item from a parked vehicle, or riding in a vehicle which is being parked or driven away;

2. Departing from or returning to a vehicle which is parked in the parking structure;

3. Traversing the Government Center parking structure on its ground floor or traversing the ground-level Government Center parking lots to access or return from the buildings at the Government Center or the Shoppes at Chino Hills;

4. Attending a City of Chino Hills authorized event in the Government Center Parking Facilities;

5. Authorized by the City of Chino Hills' City Manager or designee to be present; or

6. A City employee or City contractor performing official duties such as maintenance, law enforcement or other public purposes.

B. Government Center Parking Facilities are closed from 11:00 p.m. to 6:00 a.m., daily, and no person or vehicle shall be present in or on the Government Center Parking Facilities during these times except City employees and contractors, and vehicles displaying a valid "Government Center Parking Permit."

C. No person shall be deemed guilty of a violation of this section unless proper signage has been posted in accordance with Section 12.46.030 of this chapter.

D. Any person violating this section shall be deemed guilty of an infraction of forty-three dollars ($43.00) and subject to punishment in accordance with Section 1.36.010 et seq. of this code.

E. Any vehicle in violation of this ordinance may be towed at owner's expense.

F. For purposes of this chapter, 'Government Center' means, includes, and refers to Assessor's Parcel Numbers 1022-021-30, 1022-021-31, 1022-021-35, 1022-021-36, and 1022-021-40 which, taken together, are the site of Chino Hills City Hall, the Chino Hills Police Station, the James S. Thalman Chino Hills Branch Library, and a multi-level public parking structure, and overflow parking.

Signs posted as provided in this chapter shall conform to the following requirements:

A. Each sign shall be no smaller than twenty-two (22) by thirty (30) inches;

B. Signs shall have the word "NOTICE" two (2) inches in height, and all other lettering shall be at least five-eights (⅝) inches in height;

C. Signs shall be posted at every vehicular and pedestrian entrance to the Government Center parking structure and every 100 feet on the perimeter of the surface parking lots;

D. The following wording shall appear on each sign substantially as follows:

NOTICE

Public use of Government Center Parking Facilities is reserved only for pedestrians accessing or returning from the Government Center buildings and parking and retrieving of vehicles. Accessing or remaining in Government Center Parking Facilities for any other purpose shall be punishable as an INFRACTION. Government Center Parking Facilities are closed from 11 PM to 6 AM, daily, except to City employees and contractors, and vehicles displaying a valid "Government Center Parking Permit." Any violation will be cited and violating vehicles will be cited or towed at owner's expense. C.H.M.C. § 12.46.020 & Cal. Pen. Code § 602 (q).
