20.20.010 - Limitation on issuance of city entitlements.

No grading permit, building permit or other city entitlement will be issued for land within a subdivision or residential development subject to the provisions of Title 20 of this code unless and until development allotment is first awarded. The city council may grant an exception to the terms of this section if it finds:

A. The exception is not contrary to the purpose and intent of this title; and

B. The requirements for a variance are satisfied by the applicant.

20.20.020 - Condition on development permits.

All permits for residential development, including but not limited to RPD permits and MPPD conditional use permits, which are governed by the residential development control system and are approved by the city during the term of Title 20 of this code shall be subject to a condition providing that permit approval is complete but no further rights for development will accrue and no grading permit, building permit or other city entitlement will be issued for the land within the permit area until and unless a development allotment is first awarded.

20.20.030 - Subdivision maps.

All tentative maps for subdivisions of five or more residential dwelling units which are governed by the residential development controls system and are approved by the city during the term of Title 20 of this code, shall be subject to a condition providing that the final map may be approved and the final map may be recorded prior to the awarding of a development allotment, provided that no grading permit, building permit, or other city entitlement will be issued for the land within the subdivision until and unless a development allotment is first awarded. Where a tentative tract map on a subdivision of five or more units are governed by the residential development control system was approved prior to the effective date of Chapter 20.01, the final map may be approved and recorded prior to the awarding of a development allotment for land within the subdivision, provided that no grading permit, building permit or other city entitlement will be issued for the land within the subdivision until and unless a development allotment is first awarded.
