19.60.010 - Similar uses permitted by commission determination.

A. It is recognized that in the development of comprehensive zoning regulations:

  1. Not all uses of land can be listed, nor can all future uses be anticipated;

  2. A use may have been omitted from the list of those specified as permissible in each of the various zones in this title designated; or

  3. Ambiguity may arise concerning the appropriate classification of a particular use within the meaning and intent of this title.

Hence, the phrase, "other uses which the commission may determine to be similar to those listed above and not more obnoxious or detrimental to other uses permitted in the zone or to the public health, safety, and welfare," appears under "uses permitted" in each zone.

(Ord. 403 § 1 (part), 1978: prior code § 9601(A).)

B. Findings. In permitting or classifying an unlisted use, the commission shall first make a finding that all of the following conditions exist:

  1. That the use is in keeping with the stated intent and purpose of the zone;
