10.30.010 - Alcoholic beverages in public places.

A. No person may drink any alcoholic beverages, or hold or exercise possession or control of any open container containing any such alcoholic beverages:

  1. On any street, sidewalk, highway or alley;

  2. On any public school ground, bleacher or stadium;

  3. In any public place, place of public assembly, or in any place open to the public, except as set forth in subsection F. [6.];

  4. In or on any building or premises owned or occupied by the city or any other governmental agency;

  5. On any private street, building or other private property within the city without the consent of the person or entity in possession or control of the private property; or

  6. In any area within any public park posted to prohibit consumption of such beverages.

B. As used in this chapter, "alcoholic beverages" includes alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances.

10.30.020 - Exceptions.

The provisions of Section 10.30.010 do not prohibit the possession or consumption of alcoholic beverages:

A. In a public park when the park is occupied by a group or an organization for the purpose of a social gathering on the part of such group or organization and any necessary permits have been issued by the proper authority; or

B. In or on any building or premises or public right-of-way which is owned, occupied or controlled by the city or any other government agency when such drinking is in or on premises where the sale or dispensing of alcoholic beverages is authorized by a license or permit and has been approved by such agency.
