§ 5.10.350. Operational regulations.

In addition to the general provisions provided in Article I of this chapter, the following additional conditions and regulations shall apply to compact mobile food operations within the City:

A. The vendor permit shall at all times be displayed conspicuously on the vendor's person or, if applicable, on the mobile unit.

B. Compact mobile food operations shall conduct only "limited food preparation," as defined in California Health and Safety Code Section 113818 or its successor provision. A compact mobile food operation may display or sell food outdoors if all of the following conditions are satisfied:

  1. Overhead protection is provided above all food display areas.

  2. Food items are stored consistent with Part 7 of Division 104 of the California Health and Safety Code (California Retail Food Code), and Napa County Department of Environmental Health regulations at all times.

  3. Outdoor displays comply with California Health and Safety Code Section 113980 and have been approved by the City.

  4. The compact mobile food operation shall not sell "potentially hazardous food" as that term is defined in Article I of this chapter or whole produce or conduct any food preparation unless it meets the applicable operational requirements of Part 7 of Division 104 of the California Health and Safety Code (California Retail Food Code), and Napa County Department of Environmental Health regulations including applicable requirements for integral equipment, handwashing, and restroom access.

C. Equipment that is required to be integral to a compact mobile food operation shall either be permanently attached to the primary unit or securely fastened to the primary unit by means that would prevent unintentional removal. Equipment may be considered integral despite being portable or otherwise removable for cleaning, maintenance, or as part of its regular function.

D. A compact mobile food operation operating from one's person, in lieu of a mobile unit, shall not conduct any food preparation or sell potentially hazardous food or whole produce.

§ 5.10.360. Locations.

Compact mobile food operations shall adhere to the requirements outlined in CMC § 5.10.100.

§ 5.10.370. Hours.

Operating hours for compact mobile food operations in commercial zones shall be limited to the hours between 7:00 a.m. and 10:00 p.m. Operating hours for compact mobile food operations in all other zones shall be limited to the hours between 8:00 a.m. and 7:00 p.m.

§ 5.10.380. Inspection.

The City shall have the authority to inspect a compact mobile food operation during the facility's hours of operation and at other reasonable times for the purpose of determining compliance with this chapter. The City may recover the costs of investigation and enforcement of this section.
