Calexico Municipal Code Ch. 16.44 Modifications and Fees

A. Conditions for Granting. The advisory agency may grant modifications to any of the requirements of this title whenever the property to be divided is of such size or shape, or is subject to such title limitations of record, or is affected by such topographical location or conditions, or is to be devoted to such use, or is subject to such regulation by Title 17 that it is impractical in the particular case to conform to the strict application of the requirements of this title.

B. Requests. Any request for modifications by a subdivider must be in writing, setting forth the facts relied upon, and it must be clearly indicated that the modification is reasonable, necessary or expedient and that it is in conformity with the spirit and intent of this title and the Subdivision Map Act.

C. Appeals. Appeals from the decisions of the advisory agency may be made to the city council within fifteen days of the date of the decision as set forth in Section 16.20.050.

Fees and charges shall be paid by the subdivider to the city to cover the costs of investigating and checking in an amount to be determined by the city council from time to time by resolution.
