6.16.010 - Animal permits required.

Every person who is the owner of four or more dogs or five or more cats over the age of four months which are not subject to a kennel license pursuant to the provisions of Chapter 6.18 of this title shall obtain a permit from the director to keep such animals. Upon denial or revocation of an animal permit, or upon notice from the director, the owner shall reduce the number of dogs and/or cats they own to no more than three dogs or no more than four cats within thirty days after notice of denial or revocation by the director pursuant to Section 6.04.100 of this title.

6.16.020 - Types of animal permits.

There shall be three types of animal permits which the director may issue:

A. Interim animal permit;

B. Ranch dog permit; and

C. Foster care permit.

6.16.030 - Interim animal permits.

The director may issue interim animal permits to persons who own more than three dogs or more than four cats provided all of the following conditions are met:

A. All dogs over the age of four months are individually licensed and have current rabies vaccinations.

B. Dogs and cats subject to an interim animal permit shall be individually identified on the original application and on all subsequent applications for renewal.

C. Dogs and cats which are subject to an interim animal permit shall be kept in such a manner as not to become a nuisance to surrounding and nearby neighbors.

D. No new or additional dogs or cats shall be added to an interim animal permit.

E. The applicant shall spay or neuter all dogs and all cats that are subject to an interim animal permit.

6.16.040 - Ranch dog permits.

The director may issue ranch dog permits to persons who own more than three dogs and who can demonstrate that said dogs are necessary to pursue a legitimate livestock production endeavor provided all of the following conditions are met:

A. All dogs over the age of four months are individually licensed and have current rabies vaccinations.

B. Dogs subject to a ranch dog permit shall be identified on the original application and on all subsequent applications for renewal.

C. Dogs which are subject to a ranch dog permit shall be kept in such a manner as not to become a nuisance to surrounding and nearby neighbors.

D. The holder of a ranch dog permit shall notify the director within ten days of the date of acquiring any new or additional dogs subject to said permit.

6.16.045 - Foster care permits.

The director may issue foster care permits to persons who own three dogs of their own and who wish to foster additional dogs on a temporary basis for a non-profit animal rescue or adoption organization that has entered into an agreement with the director for the release of sheltered animals provided that all of the following conditions are met:

A. All dogs over the age of four months that are owned by the foster care giver are individually licensed and have current rabies vaccinations.

B. Foster care permits shall be limited to no more than two additional dogs, not to exceed a total of five dogs, over the age of four months, at any time.

C. Dogs subject to a foster care permit shall not be kept for a period of more than six months at the same residence unless an extension is requested by the permittee and granted by the director.

D. Dogs which are subject to a foster care permit shall be kept in such a manner as to not become a nuisance to surrounding and nearby neighbors.

6.16.050 - Expiration of animal permits.

All animal permits shall expire on the last day of the twelfth month from the date of issuance and shall become delinquent if not renewed within thirty days of said expiration.

6.16.060 - Animal permits nontransferable.

Animal permits issued pursuant to this chapter are nontransferable as to the owner and location of the premises for which they are issued.

6.16.070 - Inspection of premises subject to an animal permit.

The director shall, prior to the issuance of an animal permit, inspect the premises where such animals are to be kept to insure compliance with the provisions of this chapter. The director may periodically inspect the premises for which an animal permit has been issued or is in the process of being renewed, to insure compliance with the provisions of this chapter and at such times as complaints are received about such permitted premises.

6.16.080 - Denial or revocation of an animal permit.

The director may, after investigation, deny or revoke an animal permit for failure to comply with the provisions of this chapter. Such denial or revocation shall be made subject to Section 6.04.100 and is subject to appeal in accordance with Section 6.04.110 of this title.
