§ 4606

(a) Prior to issuing a certificate to an applicant, the council shall require the applicant to undergo a fingerprint-based criminal history background check.

(b) The council shall submit the fingerprint images and related information to the Department of Justice pursuant to subdivision (u) of Section 11105 of the Penal Code.

(c) The Department of Justice shall provide a state response pursuant to subdivision (p) of Section 11105 of the Penal Code.

(d) The council shall request subsequent arrest notification service from the Department of Justice, as provided under Section 11105.2 of the Penal Code, for all applicants for certification for whom fingerprint images and related information are submitted to conduct a search for state-level criminal offender record information.

(e) The council is authorized to receive arrest notifications and other background materials about applicants and certificate holders from a city, county, or city and county.
