7-3-1101: DEFINITIONS:
As used in this article, unless the context otherwise clearly indicates, the following words and terms shall mean:
CITY: City of Burbank, or any employee, officer, agent, or representative authorized by the City Council, City Charter, resolution, or ordinance, to act on behalf of the City of Burbank.
PUBLIC RIGHT OF WAY: The improved or unimproved surface of and the space above and below a City easement for a public utility purpose, street, sidewalk, or similar public way of any nature, dedicated, or improved for vehicular, bicycle, and/or pedestrian-related purpose, maintained and operated by the City, used now or hereafter held by City, however required.
WAYFINDING KIOSK or KIOSK: An interactive digital device installed in the public right of way with dimensions not to exceed nine (9) feet in vertical height, three and one-half (3 ½) feet in horizontal length, nor a width larger than 13 inches, with no more than 13 square feet in digital screen display per display face, to be used by pedestrians and/or transit riders, having a primary purpose of providing wayfinding services, public information and other messaging selected by the City, and which may include commercial advertising. 7-3-1102: WAYFINDING KIOSKS:
A. Temporary or permanent Wayfinding Kiosks, intended for a public purpose or benefit, shall be allowed in the public right of way, pursuant to an approved operating agreement with the City and subject to the following objective criteria:
Sound. Wayfinding Kiosk shall not emit sound, except for two-way speaker capabilities that allow a user to have on-demand audio connection to emergency services with not more than a 70-decibel output. The maximum decibel output may be reduced pursuant to the terms of the written operating agreement with the City.
Refresh Rate. A Wayfinding Kiosk shall be subject to a non-controlled refresh rate of no more frequently than ten (10) seconds or six (6) times per minute.
Lighting. A Wayfinding Kiosk shall be internally illuminated. Each Kiosk operating system shall contain an automatic dimmer control that utilizes a Global Positioning System (“GPS”) to determine sunrise and sunset times and reduce illumination for the time period between one half-hour (½) before sunset and one-half hour (½) after sunrise, and may further contain a light sensing device, placed in a manner to prevent influence by artificial lighting, to adjust brightness as ambient light conditions change, in order to insure that the display meets the following brightness standards:
(a) The maximum brightness shall be 0.3 foot-candles above the ambient light measured two hundred fifty (250) feet perpendicular from the face of the display, unless a residential property is located within two hundred (200) feet of any portion of a Kiosk, in which case the Kiosk operator must reduce light intensity on, or shade or shield the display, or direct the lighting from such Kiosk away from such residential property such that the lighting from the Kiosk shall not result in a light intensity greater than three-tenths of one (0.3) foot-candle above ambient lighting, as measured at the property line of any residential property within two hundred (200) feet of the Wayfinding Kiosk.
(b) No Wayfinding Kiosk shall display light of such intensity that it interferes with the effectiveness of an official traffic sign, signal or device.
(c) Each Wayfinding Kiosk shall automatically shut off between the hours of 12:00 a.m. and 6:00 a.m. unless it is equipped with an automatic dimming control that meets the requirements of this section.
(d) At the time of submitting a Wayfinding Kiosk encroachment permit application, the owner applying for the permit sign shall submit a certification that this standard has been satisfied.
B. In addition to entering into an approved operating agreement with the City, an owner of a Wayfinding Kiosk pursuant to section (A) shall, at its own cost, apply for and obtain all required permits, including an encroachment permit, and comply with all regulations set forth in Title 7, Chapter 3, Article 7 of the Burbank Municipal Code, prior to installation.
C. Enforcement. Whenever a Wayfinding Kiosk is found to be unsafe or maintained in violation of any provision of this Article, the Public Works Director, or their designee may issue a notice to the owner that such Wayfinding Kiosk be changed, repaired, reconstructed, demolished or removed, as may be necessary to make effective compliance with the provisions of this Article. Any work required to be done shall be completed within ten (10) days of the date of said notice. Unless otherwise granted a written extension by the Public Works Director, or their designee, failure, neglect, or refusal to comply with such notice shall be grounds for the revocation of any permit granted under this Article, administrative citation pursuant to this code, default under the operating agreement, or any other action available under local, state, or federal law.
