§ 13.24.010. Furnishing of services—Terms—Statutory authority.

A. Pursuant to Article XI, Section 7 of the Constitution of the state of California, as the same may be amended from time to time, or any successor provision or provisions thereto, the city council of the city of Buena Park finds and declares that the furnishing of water and sewer service and the collection and disposal of garbage and refuse constitute municipal utility services which may be provided to persons or property within the corporate boundaries of the city of Buena Park, or on an extraterritorial basis as otherwise provided by law, directly by the city or pursuant to contract, franchise, permit or otherwise.

B. All such services, whether provided directly by the city or pursuant to contract, franchise, permit or otherwise, shall be charged for as municipal utility services and the same may be charged for on a consolidated basis by the city.

§ 13.24.020. Service deposit required.

Every person, on making application for municipal utility services, shall make a service deposit in accordance with and in such amounts as may be established by this city council by ordinance, resolution, executive order or in any other lawful fashion.

§ 13.24.030. Payment for services—Delinquency and termination of service.

No person shall fail or refuse to pay the municipal service charges provided for in this code or established pursuant to this code. If any person shall fail or refuse to pay the lawful charges, including both delinquent and current charges, for any municipal utility service, or portion thereof, the water service to the premises, regardless of tenancy, shall be shut off. Termination of water service for failure or refusal to pay for municipal utility services, or any portion thereof, shall occur in accordance with all requirements of law, including minimum requirements for notice and opportunity to respond.

§ 13.24.040. Violation deemed misdemeanor—Penalty.

It is unlawful for any person, firm, partnership or corporation to violate any provision or fail to comply with any of the requirements of this chapter. Any person, firm, partnership or corporation violating any provision of this chapter or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding one thousand dollars or by imprisonment not exceeding six months, or by both such fine and imprisonment. Each and every person, firm, partnership or corporation shall be deemed guilty of a separate offense for each and every day or any portion thereof during which any violation of any of the provisions of this chapter is committed, continued or permitted by such person, firm, partnership or corporation, and shall be deemed punishable therefor as provided in this chapter.

§ 13.24.050. Violation deemed nuisance—Abatement.

The violation of any of the provisions of this chapter shall constitute a nuisance and may be abated by the city through civil process by means of restraining order, preliminary or permanent injunction or in any other manner provided by law for the abatement of such nuisances.
