Chapter 9.80 — DEADLY WEAPONS

§ 9.80.010. Discharging of weapons prohibited.

No person or persons, firm, company, corporation or association shall fire or discharge any firearm, air gun, air rifle or other gun or device capable of discharging by the use of powder, air or springs, any bullet, shot or other object, or a bow with metal-tipped arrows. (Ord. 96 § 2, 1957)

§ 9.80.020. Exceptions from provisions.

The provisions of this chapter regarding the use of firearms shall not apply to peace officers in the discharge of their official duties, using reasonable care, nor to persons using firearms in necessary self-defense, or in any careful manner for the purpose of destroying noxious animals from the land owned or occupied by them, nor to bona fide shooting galleries, or to persons using firearms in a careful manner in bona fide shooting galleries or places of supervised recreation such as rifle clubs.

§ 9.80.030. Violation a misdemeanor—Penalty.

Any person or persons, firm, company, corporation or association who or which violates any of the provisions of this chapter is guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed five hundred dollars, or by imprisonment in the City Jail of the city of Brentwood or the County Jail of the county of Contra Costa for a period not to exceed six months, or by both such fine and imprisonment. § 9.80.040. Violation—Defense to prosecution—Effect on Penal Code.

It shall be a defense to any prosecution for a violation of this chapter if at the time of the alleged violation the instrument or device described in Section 1 of Ordinance 96 [1] was in good faith in the possession or control of the person using the same for use in his or her lawful occupation or employment, or for the purpose of supervised recreation. The provisions of this chapter shall not be deemed to prohibit any act specifically authorized by the Penal Code of the state of California. (Ord. 96 § 4, 1957)
