§ 5.60.050. Owner's permit requirement.

  • A. General. No person may operate a taxicab within the city without first obtaining an owner's permit under this section, unless an exception applies under Section 5.60.030(C). The owner's permit includes vehicle inspections and operating requirements.

  • B. Application. The owner shall submit a complete application in the form provided by the city. The application will include information regarding the owner, the business, the rates, the drivers and the vehicles, including fingerprinting for criminal background checks. The applicant shall submit a nonrefundable application fee in the amount established by resolution of the city council, to cover the costs of fingerprinting, background investigation, vehicle inspections, and general administrative costs in administering the permit program.

  • C. Determination. The owner's permit shall be granted within thirty days after submittal of a complete application, unless the city finds any one or more of the following:

    1. The applicant fails to submit a complete application;

    2. The applicant makes any omission, untrue statement or material misrepresentation in the application, or provides fraudulent documentation;

    3. A proposed vehicle lacks the required equipment, is improperly licensed or unsafe;

    4. The proposed company name, color scheme or insignia will tend to confuse the identification of the company or vehicles with an existing operator;

    5. The applicant has been convicted of a felony offense, or a misdemeanor offense, involving moral turpitude, theft or fraud, including any such convictions following a plea of no contest, taking into consideration the nature of the conviction, the age of the applicant at the time of the conviction, any evidence of rehabilitation, and the relationship of the conviction to the propriety of the applicant operating a vehicle for hire;

    6. The applicant has not otherwise complied with this chapter.

  • D. Terms of Permit.

    1. A permit is valid for one year from date of issuance, unless suspended or revoked. The permit must be renewed annually.

    2. A permit may not be assigned, sold or transferred to another owner, driver or vehicle.

    3. The owner shall comply with this chapter in his or her business operations.

    4. The owner ensures that each vehicle has been listed and approved as part of the application.

    5. The owner ensures that each driver has a driver's permit issued by the city.

    6. The owner must maintain a city business license.

    7. The owner shall notify the city in writing within ten days of any change of address, telephone number, vehicle or driver.

    8. The owner shall include the number of its permit in every written or oral advertisement of its services, in conformance with Government Code Section 53075.9.

    9. There is no limitation on the number of permits issued in the city, unless the city council later adopts an amendment to this chapter setting a limit.

  1. Following permit issuance, the owner shall notify the city police department of any new vehicles or drivers. New vehicles and drivers shall meet all requirements of this chapter.

§ 5.60.060. Operating regulations.

  • A. Posting. The owner shall ensure that the following information is posted or carried in each vehicle:

    1. Driver carrying a valid California driver's license;

    2. Driver's city driver's permit (under Section 5.60.100) posted in view of passengers;

    3. Vehicle registration carried in the vehicle;

    4. Owner's identification and rates to be displayed in the vehicle in view of passengers;

    5. Ability to show proof of California insurance.

  • B. Rates. No patron may be charged more than the rates submitted with the application. (Ord. 913 § 1, 2013)

§ 5.60.070. Indemnification—Insurance.

  • A. Indemnification. As a condition of receiving an owner's permit, the applicant will be required to sign a statement agreeing to indemnify, defend and hold harmless the city, as stated more specifically on the permit application.

  • B. Liability Insurance. In order to obtain an owner's permit from the city, the applicant must demonstrate that it maintains at its sole expense liability insurance meeting certain minimum requirements as established by the city's risk manager and detailed on the permit application.

§ 5.60.080. Logs and trip sheets.

  • A. Both taxicab drivers and dispatchers shall keep a contemporaneous log or trip sheet of each taxicab service rendered and produce it within twenty-four hours upon request from the city. The log or trip sheet shall include the following information:

    1. The identity of the taxicab driver and dispatcher for the taxicab service rendered;

    2. The location where the passenger(s) entered the vehicle;

    3. The time of entry of the passenger(s) at that location;

    4. The number of passenger(s) entering the cab;

    5. The time at which the passenger(s) were delivered to their final destination;

    6. The precise location of the final destination of the passenger(s);

    7. The time and location of any stops made by the passenger(s) between initial pick-up and final dropoff and collection of fare;

    8. The amount of fare collected from the passenger(s);

    9. The starting and ending mileage of each trip.

  • B. The owner shall require that the logs or trip sheets be completed by the driver and dispatcher contemporaneously with each taxicab service rendered and filed at the end of each shift. The owner shall keep the logs and trip sheets on file in his or her office for a period of sixty days, and shall make them at all times convenient to be open to examination by an authorized representative of the chief of police. The falsifying of any trip sheet by an owner, taxicab driver, or dispatch operator is grounds for the revocation of the driver's permit and owner's permit.
