5.28.010 - License—Required.

It is unlawful for any person, whether as principal, agent, owner or employee, either for himself or any other person or for any body, corporate or otherwise, or as an officer of any corporation, to commence to carry on within the corporate limits of the city, or to operate any circus, menagerie, carnival, tent show or side show, or any rack or device where the element of skill or chance is involved, without first having procured a license therefor from the city clerk.

5.28.020 - License—Fees.

The license fee shall be as set by resolution of the city council, payable in cash in advance, and, in addition, in cash in advance, a sum to be determined by the city council to cover the cost of any extra police and fire protection which may be deemed necessary.

5.28.030 - Penalty for violation.

Any person who, for himself or for any other person or persons, or for any body, corporate or otherwise, commences to carry on any business, trade, calling or occupation specified in Section 5.28.010 without first having procured the license required by Section 5.28.010, for each violation of this chapter, shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than five hundred dollars nor less than fifty dollars, or imprisoned in the city jail for a term not exceeding ninety days nor less than thirty days, or shall be punished by both such fine and imprisonment, in the discretion of the court.
