16.16.010. - Required to precede parcel map.

When a parcel map is required by this title, a tentative parcel map shall first be filed with the planning commission. The map shall meet all the requirements for tentative maps provided by the Subdivision Map Act, Government Code § 66410 et seq., and this title.

16.16.020. - Filing and processing.

Tentative maps and accompanying data shall be filed with the secretary of the planning commission and shall be processed in accordance with the Subdivision Map Act, Government Code § 66410 et seq., and the provisions of this title.

16.16.030. - Filing; copies; accompanying data.

Before presenting any subdivision map to the planning commission for its approval, each subdivider shall file with the secretary of the planning commission 12 copies of the county assessor's map showing the boundaries of the property, 12 white copies and one reproducible positive of the tentative map (together with such additional copies thereof as may be requested by the planning commission), and 12 copies of owner's statement and accompanying data, made in accordance with the requirements of sections 16.16.010, 16.16.020, this section, and 16.16.040 through 16.16.110. All of the foregoing must be filed and received not less than 12 days prior to the planning commission meeting at which it is to be considered. The time of filing a tentative map is the time at which all required data is received in the office of the secretary of the planning commission. The secretary of the planning commission shall indicate the date of filing upon all copies of the tentative map and accompanying data, and thereafter shall transmit one copy of the map to each of the following: county surveyor; the real estate commissioner of the state; the affected school district; the public utilities serving the area; the city parks and recreation commission; the county health officer; the district director of transportation (Cal-Trans), if a state or federal highway is affected; the county road department, if a county road is affected; Lahontan Regional Water Quality Control Board; special districts; or other public agencies concerned. One copy of the map and its accompanying data shall be sent to the director or public works. Within three days after such filing, the secretary of the planning commission shall forward one copy to the designated official of any adjoining city or county requesting the same as provided in the Subdivision Map Act, Government Code § 66410 et seq.

16.16.040. - Preparation.

A tentative subdivision map shall be prepared by a civil engineer registered by the state or surveyor licensed by the state.

16.16.050. - Fees.

At the time of submitting a tentative map for filing, there shall be paid and collected a filing fee of $50.00 plus the following amount per lot, to be divided by the tentative map:

A. $8.00 for each of the first 25 lots;

B. $6.00 for each of the next 25 lots;

C. $2.00 for each of the next 50 lots;

D. $1.00 for each additional lot in excess of 100.

16.16.060. - Revised tentative map fee.

If, subsequent to the approval of a tentative map by the planning commission, the subdivider submits a revised tentative map as a substitute for the tentative map theretofore approved, the subdivider shall pay a fee equal to one-fourth of the filing fee required for the filing of an original tentative map.

16.16.070. - Map number.

A. Before or concurrently with the submission of a tentative map for a division of land, the subdivider shall obtain a map number for such division. Number for subdivision maps and parcel maps will be assigned by the city surveyor.

B. When a map number has been assigned for a division of land, the subdivider shall place the number upon each tentative, final or parcel map of the division and the number shall not thereafter be changed or altered in any manner upon any such map of the division unless and until a new number shall have been assigned in the manner provided in this title.

16.16.080. - Size and scale.

Each tentative map shall be 18 inches by 26 inches or any multiple thereof and shall be drawn to such scale as to clearly show the details of the plan thereon. When practicable, such scale shall be a scale of one inch equals 20 feet, but in no case shall the scale be less than one inch equals 100 feet.

16.16.090. - Identity of subdivider.

When a tentative map is submitted, the planning commission shall require the subdivider to show the following, whichever is applicable:

A. That the subdivider is the owner of the property shown on the map as proposed for the division of land;

B. That the subdivider has an option or contract to purchase the property or that portion of which the subdivider is not the owner;

C. That the subdivider is the authorized agent of one who can comply with the requirements of subsection A or B of this section.

16.16.100. - Required data.

The tentative map shall contain the following data as an aid to the planning commission in its consideration of the design of the division of land:

A. The map number assigned by the city surveyor;

B. Sufficient legal description of the land as to define the boundaries of the proposed division of land;

C. Name and address of subdivider;

D. Name, business address and registered engineer's number of licensed surveyor's number who prepared the tentative map;

E. Name and address of record owner or owners of the land proposed to be divided;

F. The locations, names and existing widths of all adjoining highways, streets or ways;

G. The location, name, width and approximate grades of all highways, streets and ways within the proposed division of land;

H. The widths and approximate locations of all existing or proposed easements, whether public or private, for roads, drainage, sewage and public utility purposes;

I. Approximate radius of all curves;

J. The approximate lot layout and the approximate dimensions of each lot and of each building site. Where pads are utilized or proposed for building sites, engineering data shall show the existing topography and the approximate finish grading as well as the location and size of each building site;

K. Size of the smallest lot in the tract;

L. Approximate boundaries of all areas subject to inundation or stormwater overflow and the locations, widths and direction of flow of all watercourses;

M. Source of water supply, and connections and size to any city water main;

N. Proposed method of sewage disposal and connections and size to city main;

O. Statement of present district or use zone and proposed use or uses of the property;

P. Proposed public areas, if any;

Q. Contours on subdivisions;

R. Date, north point and scale;

S. Number for each lot;

T. Approximate location of each area covered by trees over four inches in diameter with a statement of the nature of the cover and the kind and approximate location of all trees with accompanied disposition of existing trees;

U. Existing use or uses of the property and the approximate outline, to scale, of any existing buildings or structures and their locations in relation to existing or proposed street and lot lines;

V. Each street shown by its actual street name or by temporary name or letter for purpose of identification until the proper name of such street is determined;

W. If the planning commission finds that a geological report is necessary to determine whether the property to be divided is subject to an existing or potential geological hazard, a written report stating how the geological conditions will affect the proposed development may be required. The report shall be prepared by a geologist experienced in engineering matters;

X. In a division of land consisting of a condominium project as defined in Civil Code § 4125, or a community apartment at defined in Business and Professions Code § 11004, the tentative map shall show the general location of all buildings and other structures to be erected, including means of access thereto;

Y. Plan and easements for drainage and for handling stormwater;

Z. Statement of the improvements and public utilities proposed to be made or installed;

AA. In a subdivision which may reasonably be expected to be resubdivided in whole or in part at some future time, there shall be shown in dotted lines on the tentative map a plan of future street extensions with special consideration given to drainage;

BB. Type and location of streetlights to be installed;

CC. All existing aerial and underground utilities.

16.16.110. - Owner's statement.

Such of the information required by section 16.16.100 as may not practicably be shown on the map shall be contained in a written owner's statement accompanying the same. When the area to be subdivided is not shown on one sheet of the required size, the planning commission may require the submission of a map showing the entire area and indicating street and lot lines only.

16.16.120. - Approval by officers of departments; filing.

Within a period of not more than 15 days from the receipt of a copy of any such tentative map, each officer or department to which such copy shall have been transmitted shall file with the planning commission the officer's or its approval necessary to make such tentative map conform to the requirements of this title coming within the jurisdiction of such officer of department.

16.16.130. - Review of recommendations by planning commission.

The planning commission shall review the recommendations of such departments and, if satisfied with the design of the subdivision, shall approve the map within 50 days after the filing of the map unless such time is extended by mutual agreement of the city and the subdivider. If the planning commission is not satisfied with the design of the subdivision, it shall disapprove or conditionally approve the map within that time.

16.16.140. - Disapproval or conditional approval; statement of reasons.

In the event that the tentative map is disapproved or conditionally approved, the planning commission shall return to the subdivider one copy with a statement of the reason for its action and a statement of what changes would be necessary to render the map acceptable. Another copy, together with a copy of the aforesaid statement, shall remain permanently in the files of the planning commission, and one copy of the statement shall be sent to the departments and agencies referred to in sections 16.16.010 through 16.16.030.

16.16.150. - Designation of improvements.

At the same time the action provided for in sections 16.16.120 through 16.16.140 is taken, the planning commission shall designate the improvements which will be required under the provisions of chapter 16.32 before approval of the subdivision map.

16.16.160. - Different tentative maps for same property.

Nothing contained in sections 16.16.120 through 16.16.150 shall be construed to prohibit the filing of different tentative maps for the same property regardless of whether the first one has been approved. Optional tentative maps may be filed at the same time. Fees for each additional tentative map shall be charged as provided in section 16.16.050.

16.16.170. - Written reports to subdivider.

Any reports or recommendations on the map of any subdivision submitted to the planning commission shall be submitted in writing to the subdivider at least three days prior to the hearing or action on the map or maps by the planning commission. Such required submission in writing shall be deemed complied with when such reports or recommendations are placed in the mail, postage prepaid, and directed to the subdivider at his designated address.

16.16.180. - Rejection where use prohibited.

The planning commission may reject a tentative map if the only practical use which can be made of the property proposed to be divided is a use prohibited by any ordinance, statute, law or other valid regulation.

16.16.190. - Initial approval; time limit.

The approval or conditional approval of a tentative subdivision map shall be for 12 months. The approval or conditional approval of a tentative parcel map shall be for 12 months.

16.16.200. - Approval; extension—Application.

The subdivider filing the tentative map may request an extension of the tentative map approval or conditional approval by written application to the planning commission, such application to be filed at least 30 days before the approval or conditional approval is due to expire. The application shall state the reasons for requesting the extension. In granting an extension, new conditions may be imposed, and existing conditions may be revised.

16.16.210. - Approval; extension—Time limit.

An extension of tentative map approval or conditional approval shall not exceed 18 months.
