16.08.010. - Defined terms.

Except as otherwise provided in this title, all terms defined in the Subdivision Map Act, Government Code § 66410 et seq., and used in this title are so defined, unless from the context of this title it clearly appears that a different meaning is intended. Other terms used are as defined in this chapter.

16.08.020. - Appeal board.

Appeal board means the city council.

16.08.030. - City planning commission.

City planning commission means the planning commission of the city and the advisory agency referred to in the Subdivision Map Act, Government Code § 66410 et seq.

16.08.040. - City street.

City street means any duly dedicated road, street, avenue, boulevard, etc., which the city has accepted and regularly maintains.

16.08.050. - Clerk of the advisory agency.

Clerk of the advisory agency means the secretary of the planning commission.

16.08.060. - Lot; parcel.

Lot and parcel are used synonymously. The term "lot" means a parcel of land established, or to be established, under the subdivision procedures contained in this title.

16.08.070. - Minor land division.

Minor land division refers to any parcel or adjoining parcels of land which are divided for the purpose of transfer of title, sale, lease, or financing into two, three or four parcels, whether for present of future uses, except that the term "minor land division" does not include:

A. Land dedicated for cemetery purposes under the Health and Safety Code § 1 et seq.;

B. The leasing of apartments, offices, stores or similar space within an existing apartment building, industrial building, commercial building, or trailer park;

C. Division by agricultural, gas, oil, or mineral leases;

D. The leasing of buildings for commercial or industrial purposes;

E. The leasing of land solely for vehicle parking areas;

F. The division of land for conducting public utility purposes or the conveyance of land by a public utility to an adjoining public utilities owner (public utility does not include municipal corporation);

G. Leasing or financing of land or buildings which serve as a functional unit of a hospital, school or church;

H. Divisions of land created by the acquisition of land by government agencies, including, but not limited to, those divisions created by the opening or widening of a public street, flood-control channel or other public improvement by dedication, condemnation or purchase;

I. A division of land defined by this chapter as a subdivision or resubdivision.
