8.28.250 - Water quality.

No person, firm or public agency shall maintain a resort where bathers are invited or permitted to use any natural bathing place when the waters thereof are within the zone of influence of known sewage discharge.

A. In fresh water streams and lakes:

  1. No sewage discharge is known to exist in the immediate vicinity of, or immediately upstream from, bathing areas;

  2. Dilution and time of travel between point of sewage discharge and bathing area are sufficient to allow natural purification to occur so that the presence of harmful organisms of sewage origin is unlikely;

  3. The flow of new water into bathing areas of streams results in at least three complete turnovers of volume in twenty-four hours in the bathing area; if this condition is not met, the waters meet the following bacteriological standards: bacteriological standards for each natural bathing place shall be as follows: Samples of water from each sampling station at a natural bathing place shall have a most probable number of coliform organisms less than one thousand per one hundred ml (ten per ml); provided, that not more than twenty percent of the samples at any sampling station in any thirty-day period may exceed one thousand per one hundred ml (ten per ml); and provided further, that no single sample when verified by a request sample taken within forty-eight hours shall exceed ten thousand per one hundred ml (one hundred per ml). Bacterial analysis shall be made in accordance with the procedures recommended by the tenth edition of the "Standard Methods for Examination of Water and Sewage" of the American Public Health Association. The combinations of portions planted on lactose broth as a presumptive media shall be at least two 1.0 ml portions, two 0.1 ml portions, and two 0.01 ml portions. All portions showing gas within forty-eight hours shall be confirmed on brilliant green bile broth. Total count not more than one thousand bacteria per milliliter, and coliform organisms, not exceeding one to two 1-milliliter portions positive in confirmed test.

8.28.260 - Lifeguards.

A. No person, firm or public agency shall maintain a resort where bathers are invited or permitted to use any natural bathing place unless adequate lifeguard service is provided.

B. At rivers or streams:

  1. To comply with Sections 24050 to 24054 of California Health and Safety Code;

  2. Rescue equipment including can buoy or rescue tube or life ring and fully equipped first aid kit and line to be provided;

  3. A square stern boat equipped with oars and oarlocks shall be available;

  4. One or more water scopes to be available for use;

  5. Boats, other than patrol boats, shall be excluded from the swimming area.

8.28.270 - Posting of notices regarding conduct.

A. No person, firm or public agency shall maintain a resort where bathers are invited or permitted to use any natural bathing place unless suitable notices are posted relating to conduct and safety practices of bathers.

B. Where dressing rooms and showers are provided:

  1. Notices must be posted in each dressing room and about the premises requesting bathers to make use of the toilets and showers, urging them to avoid spitting, spouting and blowing the nose in the water, and demanding that they refrain from rough, boisterous play;

  2. Notices shall be posted regarding exclusion of diseased persons;

  3. Notices shall be prominently posted warning bathers not to bathe in remote places, not to make long distance swims unaccompanied by a strong swimmer or boat, not to swim near piers or pilings, not to swim too soon after eating, not to dive in unknown waters, not to acquire a quick sun tan, and caution against the use of inflated apparatus;

  4. Notices to be posted not to throw glass, tin cans, paper or other refuse on the beach or in the water.
