4-7-301: PERMIT REQUIRED:

It is unlawful for any person to perform at an adult entertainment business unless such person first obtains from the director, and continues to maintain in full force and effect, an adult entertainer permit. (Ord. 98-O-2302, eff. 7-2-1998)

4-7-302: PERMIT APPLICATION:

A. No person less than eighteen (18) years of age shall be eligible for an adult entertainer permit.

B. A completed application form signed by the applicant shall be submitted to the director at the time of application for an adult entertainer permit. The application form shall request the following information:

  1. The applicant's legal name and any other names (including stage names and aliases) used by the applicant.

  2. A state driver's license or state identification card. If the applicant does not possess a state driver's license or state identification card, then the applicant shall submit a description of the applicant that sets forth the applicant's date of birth, height, weight, and hair and eye color.

  3. The applicant's present residence address.

  4. Satisfactory written evidence that the applicant is at least eighteen (18) years of age.

  5. Two (2) color photographs, taken within six (6) months prior to the date of application that clearly show the applicant's face.

  6. A nonrefundable application fee in the amount of one hundred dollars ($100.00). This fee shall not be increased.

  7. The business name and address where the applicant intends to perform.

C. If the director determines that the applicant has completed the application improperly, the director shall promptly notify the applicant of such fact and, upon request of the applicant, shall return the application. As a convenience to the applicant, upon request of the applicant, the director shall grant the applicant an extension of time of ten (10) calendar days to complete the application properly. The time period for granting or denying the requested permit shall be stayed during the period in which the applicant is granted an extension of time. Unless the applicant requests an extension of time pursuant to this subsection, nothing in this subsection shall be construed to relieve the director of the duty to make a decision within the time limits set forth in section 4-7-304 of this article.

D. Pursuant to California Government Code section 6254(f), information submitted in connection with an adult entertainer permit application is not a public record and shall not be disclosed by the city to any person other than city public safety personnel. 4-7-303: GROUNDS FOR DENIAL:

The director shall deny an application for an adult entertainer permit for any of the following causes:

A. The applicant has knowingly made any false, misleading, or fraudulent statement of material fact in the application or in any report or document required to be filed with the application.

B. The applicant is under eighteen (18) years of age.

C. The adult entertainer permit is to be used for performing in a business prohibited by state or city law. (Ord. 98-O-2302, eff. 7-2-1998)

4-7-304: APPROVAL OR DENIAL OF PERMIT:

The director shall issue a provisional adult entertainer permit upon the filing, in person by the applicant, of a completed application form, including proof of age of majority. Such provisional adult entertainer permit shall entitle the applicant to perform at an adult entertainment business pending the director's decision on the application. The provisional adult entertainer permit shall expire upon the director's decision on the application. The director shall within sixty (60) city business days of the filing of an application, approve and issue the adult entertainer permit if a complete application has been submitted and there are no grounds for denial; otherwise, the permit shall be denied. Notice of the approval or denial of the permit shall be given to the applicant in writing by first class mail, postage prepaid, deposited in the course of transmission with the United States postal service on the day of such decision. If the application is denied, the director shall attach to the notice a statement of the reasons for the denial. The times set forth in this section shall not be extended except upon the written consent of the applicant. Any interested person may appeal the decision of the director to the hearing officer in accordance with article 5 of this chapter. (Ord. 98-O-2302, eff. 7-2-1998, amd. 4-7-305: NONTRANSFERABLE:

A. No adult entertainer permit shall authorize the permittee to perform at an adult entertainment business other than the business stated in the application for the permit.

B. No adult entertainer permit issued pursuant to this article shall be transferable.

C. Any attempt to transfer an adult entertainer permit is hereby declared invalid and the permit shall automatically become void effective the date of such attempted transfer. (Ord. 98-O-2302, eff. 7-2-1998)

4-7-306: DISPLAY OF PERMIT:

Every entertainer shall have his or her adult entertainer permit available for inspection at all times during which such entertainer is on the premises of the adult entertainment business at which the entertainer performs. (Ord. 98-O-2302, eff. 7-2-1998)

4-7-307: TERM OF PERMIT:

An adult entertainer permit issued under this article shall be valid for twelve (12) months from the date of issuance unless suspended or revoked. (Ord. 98-O-2302, eff. 7-2-1998)

4-7-308: RENEWAL:

An entertainer permitted under this article shall submit an application for renewal prior to the expiration of the permit issued for such entertainer. The renewal application shall consist of all of the elements prescribed by subsection 4-7-302B of this article for an initial application other than proof of age. (Ord. 98-O-2302, eff. 7-2-1998; amd.
