4-3-701: PERMIT REQUIRED:¶
No person shall move or cause to be moved any building or structure, or portion thereof, on or over any street or other public property without first obtaining a permit issued under the provisions of chapter 1, article 1 of this title. Each separate section or portion of a building or structure shall require a separate permit. (1962 Code § 9-3.101 et seq.)
4-3-702: CRITERIA FOR ISSUANCE OR DENIAL OF PERMIT:¶
Issuance or denial of a permit shall be based on the criteria of section 4-1-103 of this title, excluding subsection 4-1-103A1 of this title; and with the following additional criteria which require denial of the permit if:
A. The size of the building or structure would cause undue interference with public utilities, or other fixtures located in the public right-of-way.
B. The size or weight of the building or structure would cause damage to the street or other public right-of-way.
C. The size of the building or structure would cause damage to trees or necessitate excessive trimming of trees. (1962 Code § 9-3.101 et seq.)
4-3-703: TERM OF PERMIT:¶
Permits issued under this article for moving of buildings or structures shall designate the specific times within which such building or structure may be moved; provided further, that the time may be extended upon a showing of good cause by the permittee. (1962 Code § 9-3.101 et seq.)
4-3-704: RESTRICTIONS AND PROHIBITIONS:¶
The movement of buildings and structures governed by the provisions of this article shall be subject to the following requirements, restrictions and prohibitions:
A. Every wheel of the equipment used for moving the building or structure shall be equipped with a pneumatic tire.
B. Movement is permitted only between the hours from twelve o'clock (12:00) midnight to six o'clock (6:00) A.M. of any day.
C. The structure or building shall have attached thereto red lights which are affixed not more than six feet (6') above the surface of the roadway, with a minimum of one such light at each corner of such building or structure and at a minimum interval of five feet (5') along all sides of such building or structure; and such lights shall be activated at all times the building or structure is being moved. 4-3-705: INSURANCE REQUIRED:¶
Upon issuance of the permit under this article, and at all times the permit is in effect, the permittee shall provide and maintain insurance covering permittee's operations in an amount not less than one million dollars ($1,000,000.00). The insurance shall comply with title 3, chapter 4 of this Code. (1962 Code § 9-3.101 et seq.)
