Beverly Hills Municipal Code Art. 28.5 R-4 Permits

Notwithstanding any other provision of this chapter, upon application by a property owner in a form satisfactory to the director of planning and community development, the reviewing authority may issue an R-4 permit to the following development standards as provided within this chapter:

A. Subsections 10-3-2808B, C and E1 regarding rear setbacks;

B. Subsection 10-3-2804D1 regarding the height of buildings and rooftop bathroom facilities;

C. Section 10-3-2806 C. regarding the depth of required modulation;

D. Section 10-3-2809 regarding length of buildings;

E. Section 10-3-2813 regarding front yard paving;

F. Section 10-3-2819 to permit residential units above existing garages or carports;

G. Subsection 10-3-1238 A. regarding setback encroachments;

H. Subsection 10-3-2806 D.4.b.i. regarding the percentage of front façade of the first two (2) stories of a large scale multiple residential development that is required to be built to the front setback line;

I. Section 10-3-2804 D.2. regarding extension of legally nonconforming height;

J. Section 10-3-5001 regarding multi-family accessory dwelling unit development standards;

K. Sections 10-3-2808 B. and C. regarding replacement or expansion of a garage or carport; and

L. Section 10-3-2816 F. regarding unit bonus parking. (Ord. 96-O-2266, eff. 10-18-1996; amd. If an application for an R-4 permit accompanies an application for any other type of discretionary approval from the planning commission or the city council for the same site area, then the reviewing authority for the other discretionary approval shall also be the reviewing authority for the application for an R-4 permit and shall conduct a noticed public hearing regarding the requested R-4 permit.

Except as provided in this section or as otherwise specified, the reviewing authority for an R-4 permit shall be the director of planning and community development. If, in the opinion of the director, an application merits review by the planning commission, the director may refer such application to the planning commission and the planning commission shall serve as the reviewing authority and shall conduct a noticed public hearing regarding the requested R-4 permit. Noticing of an R-4 permit application shall be completed in accordance with article 2.5 of this chapter and the city's public notice guidelines. (Ord. 14-O-2661, eff. 6-20-2014)

In granting an R-4 permit, the reviewing authority may impose such restrictions or conditions as it deems necessary or proper to satisfy the findings required for such permit. (Ord. 96-O-2266, eff. 10-18-1996)

The applicant or any person aggrieved by any decision regarding an R-4 permit by a reviewing authority other than the city council may appeal the decision to the city council as provided in title 1, chapter 4, article 1 of this code. (Ord. 96-O-2266, eff. 10-18-1996)

Unless otherwise provided in the resolution granting an R-4 permit, the exercise of rights granted in such approval shall be commenced in accordance with the time limits imposed by section 10-3-207 of this chapter. (Ord. 02-O-2411, eff. 11-22-2002)
