11.44.010 Statutory provisions adopted.

California Penal Code, Section 836.5 a, b, c, and d (Public Officers and Employees, Arrest Without Warrant, Grounds, Civil Liability, Notice to Appear, Officers and Employees of Local Agencies), are adopted as part of this title. (Ord. 4883-NS § 1 Exhibit A, Ch. 9 Art. 1 § 1, 1976)

11.44.020 Persons authorized to make arrests.

This chapter shall authorize the chief of environmental health and such persons as the chief may designate to make arrests for violations of certain ordinances and statutes. (Ord. 4883-NS § 1 Exhibit A, Ch. 9 Art. 2 § 1, 1976)

11.44.030 Arrest procedures--Chief of environmental health powers and duties.

The chief of environmental health and such persons as the chief may designate may arrest a person without a warrant whenever the chief or their designee has reasonable cause to believe that the person has committed a public offense in the presence of the chief or their designee which is a violation of any statute or ordinance which the chief is empowered to enforce. In any case in which a person is arrested pursuant to the provisions of this title and the person arrested does not demand to be taken before a magistrate, the chief or their designee shall prepare a written notice to appear and release the person on such person’s promise to appear as prescribed by Penal Code Section 853.6.
