20.08.010 Interpretation generally.

As used in this title, unless the context otherwise indicates, the following words and phrases shall have the meanings as set forth in this chapter. (Ord. 7120-NS § 5 (part), 2009)

20.08.020 Alteration.

Any change in the weight, depth, height, area, thickness, or type of display of an existing sign. (Ord. 7120-NS § 5 (part), 2009)

20.08.030 Awning.

A shelter or cover other than a marquee sign that projects from and is supported entirely by the exterior wall of a building and may be of a type which can be retracted or folded against the face of a supporting building. (Ord. 7120-NS § 5 (part), 2009)

20.08.040 Bulletin board.

A sign located at and maintained by a park, church, school, library, community center or similar institution. (Ord. 7120-NS § 5 (part), 2009)

20.08.050 District.

Any zoning district designated in the zoning ordinance of the City. (Ord. 7120-NS § 5 (part), 2009)

20.08.060 Existing grade.

The elevation of the ground at any point within a three-foot radius of the base of the sign as shown on the required survey submitted in conjunction with an application for a permit required pursuant to this title excluding any filling, berming, mounding, or excavating solely for the purpose of locating the sign. In the case of a sign that is within five feet of a public sidewalk, alley, or other public way, the grade shall be the elevation of the sidewalk, alley, or public way. 20.08.070 Flag.

A sign attached to a pole or a structure that has characters, letters, illustrations or ornamentations applied to cloth, paper, fabric or other lightweight material, with only such material for a backing. Flags include banners or pennants that are suspended so that they are actuated by wind currents. (Ord. 7120-NS § 5 (part), 2009)

20.08.080 Ground sign.

A sign that is supported by one or more uprights, poles or braces in or upon the ground and which is not attached to a building. (Ord. 7120-NS § 5 (part), 2009)

20.08.090 Illuminated sign.

A sign that is illuminated by light located on the surface of the sign or in the interior of the sign, or that is lighted by a light the source of which is not an integral part of the sign. (Ord. 7120-NS § 5 (part), 2009)

20.08.100 Marquee.

Any structure, other than an awning, attached to and supported by a building and extending beyond an exterior wall of a building. (Ord. 7120-NS § 5 (part), 2009)

20.08.110 Monument sign.

A ground sign not exceeding six feet in total height that is supported by a solid base on the ground rather than by a pole or poles. (Ord. 7120-NS § 5 (part), 2009)

20.08.120 Moving sign.

A sign that has any actual or apparent moving, revolving or rotating parts actuated by electric, electronic, kinetic or mechanical devices or by wind currents including, but not limited to, banners, pennants, flags, balloons, signs that are constructed of or faced with any highly reflective material, signs that change or appear to change color, and signs where the intensity of lighting changes or appears to change, but not including time or temperature recording devices. 20.08.130 Mural.

A pictorial representation applied to and made an integral part of an exterior wall. A mural shall be considered a wall sign if it contains words, logos, trademarks or graphic representations of any person, product or service that identify or advertise a business, whether on the same premises or on another premises. Signatures shall be allowed and limited to a maximum of two square feet in size. Artist signatures shall be limited to the lesser of (A) a maximum of two square feet per signature, or (B) no more than five percent of the mural. (Ord. 7120-NS § 5 (part), 2009)

20.08.140 Off-premises sign.

A sign that contains any message chosen by a person other than the person in control of the premises upon which the sign is located. (Ord. 7120-NS § 5 (part), 2009)

20.08.150 On-premises sign.

A sign that contains any message chosen by the person in control of the premises upon which the sign is located. (Ord. 7120-NS § 5 (part), 2009)

20.08.160 Pole sign.

A permanent freestanding ground sign directly supported by a pole or poles with air space between the poles, except that a sign with a base on grade whose height is at least fifteen (15) percent of the total sign height and in which no greater than ten (10) percent of the total height of the sign is open air space shall not be considered a pole sign. Pole signs do not include flags or banners attached to poles. (Ord. 7120-NS § 5 (part), 2009)

20.08.170 Portable sign.

Any sign not permanently attached to the ground or other permanent structure or a sign designed to be transported including, but not limited to, signs designed to be transported by means of wheels; signs made as A- frames or T-frames; menu and sandwich board signs; and signs attached to or painted on vehicles parked and visible from the public right-of-way, unless said vehicle is used in the normal day-to-day operations of the business identified on the sign. 20.08.180 Premises.

A lot or parcel of real property or any portion thereof that is used separately from other portions thereof, or any building located thereon, or any portion of such building which has a separate street address. (Ord. 7120-NS § 5 (part), 2009)

20.08.190 Projecting sign.

A sign that is primarily attached to the exterior wall of a building and extends beyond such exterior wall by more than twelve (12) inches. Projecting signs include signs that extend from the building wall into or above the public right-of-way. (Ord. 7120-NS § 5 (part), 2009)

20.08.200 Roof sign.

A sign that is either painted upon or attached wholly to the roof of any building, or which is attached to or painted upon a structure attached wholly to the roof of a building. “Roof sign” does not include a sign painted upon a roof that is not visible from the ground. 20.08.210 Shingle sign.

A small sign suspended under a marquee, covered walkway or canopy. (Ord. 7120-NS § 5 (part), 2009)

20.08.220 Sign.

Any words, lettering, parts of letters, figures, numerals, phrases, sentences, emblems, devices, designs, trade names or marks or combinations thereof, by which anything is made known, such as the designation of an individual, a firm, an association, a profession, a business, a building address, a building name or other identification, a commodity, product or idea including all parts, portions, units and materials composing the same, together with the frame, background, surface, support or enclosure therefor, if any. 20.08.230 Sign area.

Any area included within the outer dimensions of a sign, including borders, frames, and structural supports. (Ord. 7120-NS § 5 (part), 2009)

20.08.240 Temporary sign.

Any sign that refers to an event of limited duration, including, but not limited to, entertainment, sporting events, elections, construction, sales of goods or real estate, rental of real estate, governmental actions of which public notice is required by law to be posted, or time-limited events of public interest. As used herein, the term “event” does not include short-term promotions or sales of commercial goods or services that are conducted by a business. (Ord. 7120-NS § 5 (part), 2009)

20.08.250 Wall sign.

A sign that is attached to and placed flat against any exterior wall of a building, or which is painted on any exterior wall of a building, but is not a mural. (Ord. 7120-NS § 5 (part), 2009)

20.08.260 Window sign.

A sign that is attached to or painted on either the inside or outside of an exterior window of a building or which is placed or intended to have the advertising thereon viewed primarily outdoors through an exterior window. (Ord. 7120-NS § 5 (part), 2009)

20.08.270 Wind sign.

Any cloth or plastic or other flexible light material made in strips, triangles or other shapes, which are fastened together at intervals by wire, rope, cord, string or other means in such manner as to move by wind pressure and which are used or displayed to attract attention.
