Chapter 12.36 — RECYCLED MATERIALS COLLECTION PROGRAM

12.36.010 Purpose of municipal program.

The City Council of the City finds and determines that a municipal program for the collection, disposal and recycling of metals, glass and paper placed at curbside is in the public interest and serves to promote the general welfare of the City. (Ord. 5266-NS § 2, 1980; Ord. 4689-NS § 1, 1974)

12.36.020 Definitions.

For the purposes of this chapter the following words and phrases shall have the meanings as set forth hereinafter unless the context appears otherwise:

A. "Nonprofit organization" means a religious, educational, civic or charitable organization incorporated under the laws of the State of California and the Internal Revenue Code, Title 26 U.S.C., Section 501(b)(3).

B. "Person" means any individual, association, firm, organization, sole proprietorship, partnership or corporation, whether or not said entities are operated for profit.

C. "Recycled materials" means any materials including but not limited to metals, glass or paper that have been placed at the curbside for the purpose of being collected and recycled under this program. (Ord. 5702-NS § 1 (part), 1986; Ord. 5266-NS § 2, 1980; Ord. 4689-NS § 2, 1974)

12.36.030 Collection and recycling program--City Manager to delegate

authority.

The City Manager is hereby authorized to delegate the responsibility of conducting such a recycling program to the City Department of Public Works or to any organization qualified to conduct such a recycling program. 12.36.060 Collection and recycling program--By other agencies authorized

when.

The City Manager may authorize non-profit, religious or charitable organizations other than those authorized pursuant to Section 12.36.030 to collect recycled materials placed at the curbside, under certain terms and conditions. (Ord. 5702-NS § 1 (part), 1986; Ord. 5266-NS § 2, 1980; Ord. 4689-NS § 4, 1974)

12.36.070 Collection by unauthorized persons prohibited--Penalty.

It shall be unlawful for any person, not otherwise excepted by the provisions of this chapter or as authorized in writing by the City Manager, to collect recycled materials from the curbside in the City. Any person violating any provision or failing to comply with any of the requirements of this chapter shall be deemed guilty of an infraction as set forth in Chapter 1.20 of this code.
