11.08.010 Approved.

"Approved," when used in connection with any material, equipment, method, operation or type of construction except building construction, means:

A. Meeting the requirements and approval of the chief of environmental health based upon the results of investigations or tests conducted by a nationally recognized testing agency; or

B. Based upon accepted principles and standards established by national authorities, technical, health or scientific organizations or agencies. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 5, 1976)

11.08.020 Chief of environmental health.

"Chief of environmental health" means the chief of environmental health of the City, or their designee, including but not limited to sanitarians, vector control technicians and animal-care services personnel. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 8, 1976)

11.08.030 City Manager.

"City Manager" means the City Manager of the City of Berkeley or their designee. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 6, 1976)

11.08.040 Construction.

Unless the provisions or context otherwise require, these definitions, rules of construction and the general provisions set forth in Chapter 11.04 shall govern the construction of this title. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 1, 1976)

11.08.050 Construction of genders.

The neutral gender includes the feminine and masculine. "They/them" shall indicate a singular individual, unless the context indicates the contrary. (Ord. 7670-NS § 5, 2019; Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 3, 1976)

11.08.060 Construction of singular and plural.

The singular number includes the plural and the plural, the singular. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 4, 1976)

11.08.070 Construction of tenses.

The present tense includes the past and future tenses; and the future, the present. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 2, 1976)

11.08.080 Health officer.

"Health officer" means the health officer of the City, or their designee. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 7, 1976)

11.08.090 Operate.

"Operate" includes "conduct" and "maintain" and any of its variants. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 9, 1976)

11.08.100 Person.

"Person" includes any person, firm, association, organization, partnership, business trust, joint venture, corporation or company, and includes the United States, the state of California, the City of Berkeley, and any officer or agency thereof. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 10, 1976)

11.08.110 Place.

"Place" includes premises, land, place, building, structure, wharf, pier or dock. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 11, 1976)

11.08.120 Possess.

"Possess" includes control, own, lease, occupy, possess or have charge of or dominion over. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 12, 1976)

11.08.130 Shall and may.

"Shall" is mandatory and "may" is permissive. (Ord. 4883-NS § 1 Exhibit A, Ch. 1 Art. 2 § 13, 1976)

11.08.140 Structure.

"Structure" is that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner and which requires location on the ground or attachment to something having location on the ground, as defined in Ordinance 4646-NS, adopting and modifying the Uniform Building Code.
