10.08.010 Impoundment--Required when--Poundmaster duty.¶
It shall be the duty of the poundmaster to take up and impound any ox, bull, cow, horse, stallion, colt, jack, mule, calf, sheep, goat, hog, duck, goose, chicken or pigeon found running or being at large, staked or tied, or being herded or pastured in any public street, avenue, lane, alley, court, place or public grounds in the City; provided, this chapter shall not apply to a horse or any other animal hitched or fastened by a rope, chain or other line not allowing more than four feet of liberty. 10.08.020 Impoundment--Animals running at large during quarantine.¶
Whenever a quarantine has been declared in accordance with the provisions of Division 3, Chapter 3, Article 1 of the Health and Safety Code of the state, it shall be the duty of the poundmaster to impound all animals found running at large in violation of said quarantine. 10.08.030 Taking animals from poundmaster or pound prohibited when.¶
No person shall rescue any animal from the possession of the poundmaster while conveying or about to convey the same to the City pound, or make a pound breach, or in any way, directly or indirectly, take or deliver any animal out of the pound without lawful authority; and the poundmaster, their deputies or assistants may lawfully resist with reasonable and necessary force the attempt of any person to interfere with the discharge of their duties. 10.08.040 Impoundment--Notice to owner required--Sale or destruction¶
authorized when.
When any animal is impounded, the poundmaster shall immediately notify the owner thereof, if known to them. If said animal is not reclaimed within five days after such notice is given, or if the owner is unknown within five days after impounding, the poundmaster shall proceed to sell the same to whomever shall have expressed a willingness to buy. In case there is no bidder for such animal, the poundmaster shall proceed to destroy the same, without unnecessary cruelty, and shall dispose of the carcass in such manner as may be directed by the Health Department. 10.08.050 Care of impounded animals.¶
The poundmaster shall cause all animals impounded by them to be provided with sufficient water and proper and sufficient food, and upon their neglecting to do so, the poundmaster shall be liable to the owner for all damages arising therefrom. (Ord. 1308-NS § 4, 1927)
10.08.060 Impoundment--Fee schedule.¶
Fees chargeable for impoundment, board fees, adoption fees, and other fees chargeable by the poundmaster shall be established by resolution of the City Council. 10.08.070 Impoundment--Records to be kept.¶
The poundmaster shall keep a record of the number, description and disposition of all animals impounded, showing the date of receipt, date and manner of disposal, the name of person reclaiming, redeeming or purchasing and the date thereof, the reason for destruction, and the charges and proceeds of sales. 10.08.080 Redemption procedures.¶
The owner of any animal impounded shall have the right to reclaim the same at any time prior to the sale thereof, upon payment to the poundmaster of the charges provided in Section 10.08.060 of this chapter for impounding and keeping said animal, or, if sold, to receive the proceeds of the sale thereof, less the charges aforesaid mentioned, within thirty days after said sale, upon satisfactory proof of their ownership; provided, that in order to reclaim an unlicensed dog, the owner shall first obtain a license and shall present the same to the poundmaster for inspection. 10.08.090 Dead animals--Disposal procedures authorized--Fee schedule.¶
It shall also be the duty of the poundmaster upon the request of any owner or possessor of any dead animal, forthwith to bury or burn the same in such place as may be provided by the City for that purpose, or to dispose of the same in such manner as the poundmaster may deem expedient, for which services they shall charge and collect from the owner or possessor of such animal, the following fees:
A. For disposing of horses, oxen, bulls or cows, per head--Seventy-five dollars.
B. For disposing of jacks, mules, steers, or colts, per head--Seventy-five dollars.
C. For disposing of hogs, sheep, goats or calves, per head--Thirty-seven dollars and fifty cents.
D. For disposing of ducks, geese, or other fowls, each--Seventy-five cents.
E. For disposing of dogs--Six dollars.
F. For picking up dogs to be destroyed--Three dollars and seventy-five cents.
G. For picking up animals, other than dogs, to be destroyed--Three dollars and seventy-five cents to fifteen dollars depending upon type of animal.
H. For disposing of other animals not enumerated--One dollar and fifty cents to seventy-five dollars depending upon type of animal.
I. For the pickup and disposal of dead animals from veterinary hospitals--Five dollars per animal, fifteen-dollar minimum for each pickup. 10.08.100 Dead animals--Failure to bury after notice--Poundmaster¶

If any person fails or neglects for twelve hours after a notice in writing from the poundmaster or any executive officer of the City to bury any dead animal as provided by ordinance then in such case it shall be the duty of the poundmaster to forthwith bury or burn or otherwise dispose of the same, and the poundmaster shall charge and collect from the owner or possessor of such dead animal the fees hereinbefore provided, which fees it shall be the duty of such owner or possessor of any dead animal to pay. 10.08.110 Dead animals--In public places--Poundmaster disposal required.¶
It shall be the duty of the poundmaster, whenever it comes to their knowledge that any dead animal is upon any of the public streets, alleys, places or parks in the City, promptly to bury or burn or otherwise dispose of the same in the manner hereinabove provided. (Ord. 1308-NS § 8, 1927)
