Sec. 28-16. - Definitions.¶
The following words, terms and phrases when used in this article, have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Handbill includes any printed or written advertising matter, any sample or device, dodger, circular, leaflet, pamphlet, newspaper, paper, booklet or any other printed matter or literature.
Person includes any person, firm, partnership, association, corporation, company or organization of any kind.

Sec. 28-17. - Distributing on public property.¶
(a) It is unlawful for any person to distribute or cause to be distributed, to circulate or pass, to or among pedestrians any handbill with the use of rocks, pebbles or other weighty matter by throwing or placing the same in or along any public thoroughfare, park, ground or other public place within the city.
(b) It is unlawful for any person to distribute or cause to be distributed, to circulate or pass, to or among pedestrians any handbill by throwing or placing the same in or along any public thoroughfare, park, ground or other public place within the city unless the person has obtained all required city permits.

Sec. 28-18. - Placing in vehicles.¶
(a) It is unlawful for any person to distribute or cause to be distributed, to circulate or pass any handbill either with or without the use of rocks, pebbles or other weighty matter by throwing or placing the same in or upon any automobile or other vehicle.
(b) It is unlawful for any person to distribute or cause to be distributed, to circulate or pass any handbill by throwing or placing the same in or upon any automobile or other vehicle unless the person has obtained all required city permits.

Sec. 28-19. - Distributing on private property.¶
(a) It is unlawful for any person to distribute or cause to be distributed, to circulate or pass any handbills either with or without the use of rocks, pebbles or other weighty matter by throwing or placing the same in or upon any private yard, grounds, walk, porch, steps, vestibule, house, residence, building or any other private property.
(b) It is unlawful for any person to distribute or cause to be distributed, to circulate or pass any handbills by throwing or placing the same in or upon any private yard, grounds, walk, porch, steps, vestibule, house, residence, building or any other private property unless the person has obtained all required city permits.

Sec. 28-20. - Public nuisance.¶
The violation of any provision of this article is deemed a public nuisance. In the event the City of Belmont seeks injunctive relief to enforce this article, it shall be entitled to reasonable attorney's fees.

Sec. 28-21. - Penalty.¶
Any person who violates any provisions of this article is guilty of an infraction and upon conviction thereof shall be punished as follows:
(1) A fine not exceeding one hundred dollars ($100.00) for a first violation.
(2) A fine not exceeding two hundred dollars ($200.00) for a second violation within one (1) year.
(3) A fine not exceeding five hundred dollars ($500.00) for each additional violation of the same ordinance within one (1) year.
