§ 13.04.100. Amount established annually—Payment.¶
A. Pursuant to Section 5470 et seq., of the Health and Safety Code (hereafter "Act") and other applicable laws, effective on and after July 1, 1989, the owner of each lot or parcel of real property located within the city shall pay to the city an annual sewer standby and availability rate or charge (hereafter "rate or charge") in the manner hereafter described, in amounts as specified by resolutions adopted by the city council.
B. Annually, prior to August 10th of each calendar year, commencing in the calendar year 1989, the city council shall conduct a public hearing, notices as is provided in the Act, and thereafter establish the amount of such rates or charges for each lot or parcel located in the city for that fiscal year, and shall thereafter cause all such rates or charges to be collected on the tax roll relating to that fiscal year in the same manner, by the same persons, and at the same time as, together with and not separately from general taxes collected on behalf of the city and other taxing authorities.
C. Should the city council, prior to August 10th in any calendar year, for any reason, fail to conduct a hearing and adopt a resolution of the type referred to in subsection B of this section, no person shall be obligated to pay such rates or charges for the fiscal year commencing on July 1st preceding such August 10th.
