Sec. 5.84.010. - Tow service franchise program.

The chief of police of the city may establish a tow service franchise program and may, with the concurrence of the city manager, award a tow service franchise to one or more qualified companies. For purposes of this section, the term "qualified company" means a company determined by the chief of police and the city manager, in such officials' sole discretion, to be capable of providing satisfactory towing, emergency road

and storage services. A tow service franchise shall not be awarded to any company that lacks a current city business license or that is not current in its utility payments to the city.

Sec. 5.84.020. - Franchise agreement and fee.

Each recipient of a tow service franchise shall execute a tow service franchise agreement, which may be signed on behalf of the city by the chief of police and the city manager. Additionally, each recipient of a tow service franchise shall pay a tow service franchise fee in an amount set by resolution of the city council.

Sec. 5.84.030. - Franchise term.

The term of each tow service franchise shall be one year. Nothing in this section shall preclude the chief of police, with the concurrence of the city manager, from earlier terminating a tow service for violation of the franchise agreement or any applicable law.
