Sec. 18.22.010. - Notice of violation.

(a)

Whenever the city engineer has knowledge that real property has been divided in violation of this title and/or the Subdivision Map Act, the city engineer shall ask the city attorney to prepare a notice of intention to record a notice of violation. This notice shall be mailed to the current owner of record. This notice shall specify time, date and place for consideration by the city council.

(b)

After reviewing the matter, the city council shall determine whether or not the property has been illegally divided and whether or not a notice of violation shall be recorded against the property. If the notice of violation is ordered to be recorded, no permit or approval will be issued to develop the property until the property has been brought into compliance with this subdivision ordinance and the Subdivision Map Act.

Sec. 18.22.020. - Certificate of compliance.

(a)

Any person owning real property may request, and the city engineer shall determine, whether such real property complies with the provisions of this title and the Subdivision Map Act. Upon making such a determination, the city engineer shall cause a certificate of compliance to be filed for record with the county recorder. The certificate of compliance shall identify the real property and shall state that the division of land complies with applicable provisions of this title and the Subdivision Map Act.

(b)

If the city engineer determines that the real property does not comply with the provisions of this title and the Subdivision Map Act, the city engineer may, as a condition to granting a certificate of compliance, impose conditions which would have been applicable to the division of the property at the time the current owner of record acquired the property. If the property has the same owner of record as at the time that the illegal subdivision occurred, the city may impose conditions that would be applicable to a current subdivision of the property.
