9.12.010 - Gambling houses—Prohibited.

No person, either as owner, principal, agent, clerk, servant or employee, shall establish, open, keep, maintain or carry on, or assist in carrying on, any house, room or other place where gambling is carried on.

9.12.020 - Gambling houses—Frequenting.

No person shall become an inmate of or a visitor at any place where gambling is practiced or carried on.

9.12.030 - Gambling houses—Nuisances.

Any house or place where any game is played with cards, dice or other device for money, checks, credits or anything of value or representative of value, or where money or anything of value or representative of value is risked or staked on the issue of any game, is declared a nuisance and to be included in the terms of gambling house or place within the meaning of this chapter.

9.12.040 - Games prohibited.

No person shall deal, play or carry on, or open, or cause to be opened, or conduct either as owner, employee or otherwise, whether for hire or not, any game not mentioned or included in Section 330 of the Penal Code of the state, played with cards, dice or any device for money, checks, credits or any other representative of value,

9.12.050 - Gambling in presence of children.

No person shall deal, play or carry on, open or cause to be opened, or conduct, either as owner or employee or otherwise, whether for hire or not, any game played with cards, dice or any device, for money, checks, credits or other representative of value, with or in the presence of any minor child or in any room frequented by minor children or by any minor child.

9.12.060 - Hotel keepers, etc., not to allow.

No keeper of any hotel, roominghouse or any other place shall allow any kind of gambling or gaming for money, liquor, goods, merchandise or anything of or representing value.

9.12.070 - Possession, use, etc., of gambling devices.

No person, either as owner, lessee, agent, employee, mortgagee or otherwise, shall keep, maintain, rent, use or conduct any clock, tape, slot or card machine or any other machine, contrivance or device upon which money is staked, hazarded upon chance, or into which money is paid, deposited or played upon chance or upon the result of the action of which money or any other article or thing of value is staked, bet, hazarded, won or lost upon chance,

9.12.080 - Slot machines prohibited.

No person shall, either as owner, lessee, agent, employee, mortgagee or otherwise, operate, keep, maintain, rent, use or conduct any machine, contrivance, appliance or mechanical device upon the result of the action of which money or other valuable thing is staked or hazarded and which is operated or played by placing or depositing therein any coins, checks, slugs, balls or other articles or device or in any manner and by reason of the action whereof or as a result of the operation of which any merchandise, money, representative or article of value, check or token redeemable or exchangeable for money, or other thing of value is lost or won, or taken from or obtained from such machine, when the result of the action or operation of such machine, contrivance, appliance or mechanical device is dependent upon hazard or chance.

9.12.090 - Enforcement of chapter generally.

It shall be the duty of the chief of police and all police officers of the city to use all legal means of detecting and convicting persons violating any of the provisions of this chapter and to exercise the right of search given by law of this state and to seize and safely keep all chips, checks, cards, apparatus and things used for gambling purposes at any place that may exist contrary to this chapter, and to produce the same in court and retain them until the final disposition of any case in which such articles may be required as evidence, to be destroyed by the order of the court after proof having been made of their use of gambling purposes in the city.

9.12.100 - Adoption of state law as to search warrants.

For the purpose of enforcing this chapter, the provisions of Sections 1525 through 1540, both inclusive, except Section 1536, of the Penal Code of the state, are adopted and made a part of this chapter, the same as if fully set forth herein, and reference is made to such sections. Wherever in such sections the words "magistrate" or "justice of the peace" are used, the words "city judge" shall be deemed substituted therefor.
