15.16.010 - Establishment of board of permit appeals.

Pursuant to the California Building Code, in order to determine the suitability of alternate materials and type of construction and to provide for reasonable interpretation of the provisions of the California Building Code, there shall be and is created a board of permit appeals.

15.16.020 - Membership.

The board of permit appeals shall consist of those individuals appointed to membership on the public works advisory committee, which shall sit as the board of permit appeals whenever an appeal is filed under this chapter. Members shall be qualified by experience and training to pass upon matters pertinent under

this chapter; the Building Official serving the city, or his or her authorized representative, shall be an ex officio member and shall act as secretary of the board at the hearing of any appeal processed under this chapter.

15.16.030 - Meetings, hearing guidelines and determinations.

Interpretations of the Building Code made by the Building Official regarding intent of the Code may be appealed to an appeals board to be named as is required by CBC 113. Only interpretive decisions, determinations and questions regarding limitations of authority made by the Building Official on the Building Codes may be appealed. Items which are obvious and clear in the Code cannot be appealed, nor will such questions be heard by an appeals board. The Building Official has the right to deny an appeal if the appeal is not related to a question of interpretation or a determination based on language in the Code. Whether or not a building is unsafe or in violation of the requirements of the Code is not a matter of interpretation and is not subject to appeal, this authority is clear within the Code.

15.16.040 - Time and date scheduled for hearing.

Hearings and determinations shall be conducted and delivered in the manner set forth in Section 2.64.010 of this Code save that the board of permit appeals shall first hear the matter before any appeal to the city council. Additionally, in accordance with the requirements of the California Building Code, the board shall render all decisions and findings in writing to the Building Official. The appellant shall receive a duplicate copy. The board may recommend to the city council such new legislation as is consistent with the board's decision in the matter on appeal.

15.16.060 - Fees.

Each written notice of appeal on the form provided by the building department shall be accompanied by a nonrefundable fee of two hundred dollars. No appeal shall be accepted or heard unless accompanied by such fee.

Chapter 15.18 - RESTROOM FACILITIES

15.18.010 - Requirements to provide public restrooms

A.

Public occupancies are required to provide restrooms that are available to the public in accordance with the California Plumbing Code section 422 and accessible restrooms for those with disabilities in accordance with CBC 11B and Titles I and III of the Americans with Disabilities Act. Occupancies with employees required as part of their operations must maintain restroom facilities available for their employees. Any business which cannot provide functioning restrooms for their staff or the public are not permitted to operate or be open to the public.

Active construction sites must provide temporary restroom facilities for workers at each project respectively. These facilities must comply with Cal OSHA and Health Department requirements. (Ord. No. 1613, § 5 (Exh. A), 11-12-25)

Chapter 15.24 - EARTHQUAKE RESISTANCE STANDARDS
