9.12.010 - Card room defined.

For the purpose of this chapter, "card room" shall be deemed to be any place where games are carried on with cards, dice, dominoes or other devices which games or devices are not prohibited by Section 330 of the Penal Code of the state or which places, games or devices are not prohibited by Sections 9.12.020 through 9.12.060.

9.12.020 - Gambling—Devices illegal.

It is unlawful for any person within the limits of the City to exhibit or expose to view, or to have in his possession or under his control in any barred or barricaded house or room or in any place built or protected in any manner to make it difficult of access or ingress to police officers when two or more persons are present, any faro box, or any roulette or fantan table or layout, or any part of such layout, or any other gambling device or lottery paraphernalia prohibited in Section 330 of the Penal Code of the state.

9.12.030 - Gambling—Visiting certain places unlawful.

It is unlawful for any person to visit or resort to any such barred or barricaded house or room or other place built or protected in a manner to make it difficult of access or ingress to police officers where any such gambling device or lottery paraphernalia are exhibited or exposed to view when two or more persons are present.

9.12.040 - Gambling—Maintaining rooms for unlawful.

It is unlawful for any person to keep, conduct or maintain, within the City, any house, room, apartment, or place, used in whole or in part, as a gambling house or place where any game prohibited in Section 330 of the Penal Code of the state, is played, conducted, dealt, or carried on with cards, dice, dominoes, or other device, for money, checks, chips, credit or any other representative of value, merchandise or drinks.

9.12.050 - Gambling—Permitting unlawful.

It is unlawful for any person knowingly to permit any house, room, apartment, or place, owned by him or under his charge or control, in the City, to be used, in whole or in part, as a gambling house or place for playing, conducting, dealing, or carrying on, any game prohibited in Section 330 of the Penal Code of the state, with cards, dice, dominoes or other device, for money, checks, chips, credit, or any other representative of value, merchandise or drinks.

9.12.060 - Gambling—Games played for anything representative of value unlawful.

It is unlawful for any person to play or bet at or against, any game prohibited in Section 330 of the Penal Code of the state, which is played, conducted, dealt, or carried on with cards, dice, dominoes, or other device, for money, checks, chips, credit or any other representative of value, merchandise or drinks, in any house, room, apartment or place described in Section 9.12.040 in the City.

9.12.070 - Closing hours for pool halls, billiard parlors and card rooms.

All pool halls, billiard parlors and card rooms in this City shall close and remain closed from 2:00 a.m. of one day to 6:00 a.m. of the same day, during which hours all patrons and other persons other than the owners or employees of the business shall be excluded, except as otherwise allowed by Section 5.16.120.

9.12.080 - Dispensing of and consuming alcoholic beverages in specific areas of the City prohibited.

A. It is unlawful for any person to sell, dispense, serve, drink or consume any spirituous, vinous, malt, or other alcoholic beverage or liquid, in or upon any street, sidewalk, alley or park in the City, unless the sell, serving, dispensing, drinking or consumption of such beverage or liquid is done under and pursuant to a specific permit or license issued by the Chief of Police or his designee. Such permit or license shall be issued only to civic, charitable, fraternal, political, municipal, or county organizations or groups.

B. It is unlawful for any person to consume any alcoholic beverage in or upon any public or privately owned parking lot.
