5.56.010 - Application.

This chapter applies to seasonal sales of Christmas trees, pumpkins, and other similar items in locations not otherwise approved as year-round business operations.

5.56.020 - Permit required.

It is unlawful for any person to engage in seasonal sales except from an approved location for which a permit has been issued under this chapter.

5.56.030 - Site restrictions.

Sales lots shall be located only on property zoned for commercial purposes and which contain at least 20 improved parking spaces for customer parking, as approved by the Planning Director. Improved parking shall mean a graded surface, graveled, or dust control applied as needed.

5.56.040 - Permit fee.

Application for the permit shall be accompanied with a certificate of insurance complying with current City requirements, written authorization of the property owner and the name, address and phone number of the responsible person with a processing fee of $100.00.

5.56.050 - Site approval.

Together with the permit request, a site plan shall be submitted showing booth location, parking, and access. The Planning and Fire Departments shall review the plan to determine compliance with this chapter and other applicable regulations.

5.56.060 - Period of operation.

A. Period of Operation for Pumpkin Patch Lots. The period of operation for pumpkin patch lots shall be from the first Saturday of October through October 31st of each year.

B. Period of Operation for Christmas Tree Lots. The period of operation for Christmas tree lots shall be from the Saturday following Thanksgiving day through Christmas day of each year.

5.56.070 - Period of clean-up.

The applicant shall be granted a seven-day timeframe for removal of all materials from the site after each event.
