Atwater Municipal Code Ch. 13.18 Southwest Quadrant Storm Drainage Fee

13.18.010 - Fee established.

Pursuant to Government Code Section 66000 et. Sec., a storm drainage fee is hereby established in that area of the City known as the "Southwest Quadrant" and depicted in the map attached hereto as Exhibit "A."

13.18.020 - Drainage facilities.

The facilities to be financed by the fees are described as Alternative 2 in that document entitled "Southwest Quadrant Storm Drainage Evaluation—February 1993." Said evaluation is hereby approved and adopted.

13.18.030 - Cost share.

The cost at the facilities shall be shared as set forth in Table 5 of said Evaluation which table is attached hereto as Exhibit "B." The relationship between the fee's use and the type of development as well as the relationship between the need for the public facilities and the type of development in approval as set forth in said Evaluation.

13.18.040 - Time of payment.

In instances where the property is to be subdivided, the fee shall be paid as a condition of approval of the subdivision map. In instances where development is proposed for existing lots or parcels, the fee shall be collected at the time of issuance of the building permit.

13.18.050 - Drainage fund.

All fees collected hereunder shall be deposited in the "Southwest Quadrant Drainage Fund." Said fees and all interest which accrues therein shall only be used for the purposed as set forth in said evaluation.
